October 23, 2001 <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That it finds that the use for which the permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That Sheran Oliver is hereby granted a use permit pursuant to Section <br />40-43.1 of the Code of the City of Portsmouth, Virginia (1988) to operate a family day <br />home at 13 Pointe of View Arch, and being more particularly described as: <br /> <br />UP-01-19 <br /> <br /> Beginning at a point 357.31' southwest of the southeast <br />corner of River Reach Close and Pointe of View Arch; thence, <br />in a southwesterly direction 57.65'+ to a point; thence, in a <br />southeasterly direction 111.97'+ to a point; thence in a <br />northeasterly direction 68.39'+ to a point; thence, in a <br />northwesterly direction 117.15'+ to a point of the beginning. <br /> <br /> 3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicants and any successor in interest: <br /> <br /> (a) <br />home. <br /> <br />All employees of the family day home shall be full-time residents of the <br /> <br /> (b) The occupancy of the family day home may not exceed twelve (12) <br />children at any one time. <br /> <br /> (c) <br />of age. <br /> <br />The age range of the children shall be from newborn to twelve (12) years <br /> <br /> (d) Indoor hours of operation shall be limited to the hours between 6:00 a.m. <br />and 6:00 p.m., Monday through Friday. <br /> <br /> (e) <br />6:00 p.m. <br /> <br />Outdoor play hours shall be limited to the hours between 8:00 a.m. and <br /> <br /> (f) The outdoor play area shall be enclosed with fencing that is at least six (6) <br />feet in height. <br /> <br /> (g) The applicant shall maintain at least two (2) off-street parking spaces for <br />the family day home. <br /> <br /> (h) No on-street parking or on-street drop-off/pick up of children associated <br />with the family day home shall be permitted. <br /> <br />(i) The center shall comply with the submitted floor plan and site plan. <br /> <br /> (j) The applicant shall provide an approved plan to store, handle and remove <br />trash/garbage on-site. <br /> <br /> <br />
