October 23, 2001 <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That Mount Carmel Baptist Church is hereby granted a use permit pursuant to <br />Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) to expand its <br />church at 3310 Deep Creek Boulevard, and being more particularly described as: <br /> <br />UP-01-18 <br /> <br /> Beginning at the southwest corner of Portsmouth <br />Boulevard and Deep Creek Boulevard; thence in a westerly <br />direction approximately 218' to a point; thence in a southerly <br />direction approximately 96' to a point; thence in a westerly <br />direction approximately 131' to a point; thence in a easterly <br />direction approximately 243' to a point; thence in a northerly <br />direction approximately 220' to a point of the beginning. <br /> <br /> 3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicants and any successor in interest: <br /> <br /> (a) A site plan showing parking, landscaping, and location for garbage <br />storage and collection must be submitted and approved by the Planning Department <br />prior to obtaining building permits. <br /> <br /> (b) The Commission of Architectural Review must approve all proposed <br />exterior alterations to the church before any site work can begin. <br /> <br /> (c) The proposed project shall not encroach into the city right-of-way and shall <br />provide the City with a survey confirming the non-encroachment prior to applying for or <br />obtaining a building permit. <br /> <br /> (d) The applicant shall comply with all applicable codes, ordinances, and <br />regulations of federal, state, and local governments and shall obtain and maintain in <br />effect all required licenses and permits. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Pitts, Whitehurst, Holley <br />Nays: None <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Whitehurst, to adopt the following <br />resolution, approved at the October 9, 2001 meeting, and was adopted by the following <br />vote: <br /> <br />01-286(d): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO SHERAN OLIVER TO OPERATE <br />A FAMILY DAY HOME AT 13 POINTE OF VIEW ARCH. <br /> <br /> WHEREAS, Sheran Oliver has made application pursuant to Section 40-43.1 <br />of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to <br />operate a family day home at 13 Pointe of View Arch, Portsmouth, Virginia; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> <br />
