October 23, 2001 (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Mount Carmel Baptist Church is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) to expand its church at 3310 Deep Creek Boulevard, and being more particularly described as: UP-01-18 Beginning at the southwest corner of Portsmouth Boulevard and Deep Creek Boulevard; thence in a westerly direction approximately 218' to a point; thence in a southerly direction approximately 96' to a point; thence in a westerly direction approximately 131' to a point; thence in a easterly direction approximately 243' to a point; thence in a northerly direction approximately 220' to a point of the beginning. 3. That the use permit is approved subject to the following conditions which shall be observed by the applicants and any successor in interest: (a) A site plan showing parking, landscaping, and location for garbage storage and collection must be submitted and approved by the Planning Department prior to obtaining building permits. (b) The Commission of Architectural Review must approve all proposed exterior alterations to the church before any site work can begin. (c) The proposed project shall not encroach into the city right-of-way and shall provide the City with a survey confirming the non-encroachment prior to applying for or obtaining a building permit. (d) The applicant shall comply with all applicable codes, ordinances, and regulations of federal, state, and local governments and shall obtain and maintain in effect all required licenses and permits. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." Ayes: Benn, Griffin, Pitts, Whitehurst, Holley Nays: None Motion by Mr. Benn, and seconded by Mr. Whitehurst, to adopt the following resolution, approved at the October 9, 2001 meeting, and was adopted by the following vote: 01-286(d): "A RESOLUTION GRANTING A USE PERMIT TO SHERAN OLIVER TO OPERATE A FAMILY DAY HOME AT 13 POINTE OF VIEW ARCH. WHEREAS, Sheran Oliver has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate a family day home at 13 Pointe of View Arch, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and
