October 23, 2001 <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That Tim and Shannon Woodland are hereby granted a use permit pursuant <br />to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for a dwelling <br />unit at 300 High Street, and being more particularly described as: <br /> <br />UP-01-17 <br /> <br /> Beginning at the northwest corner of High Street and <br />Middle Street; thence in a northerly direction 55'+ to a point; <br />thence in a westerly direction 29'+ to a point; thence in a <br />southerly direction 55'+ to a point; thence in an easterly <br />direction 29'+to a point of the beginning. <br /> <br /> 3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicants and any successor in interest: <br /> <br /> (a) <br />use. <br /> <br />Renovations shall be limited to one single-family unit above a commercial <br /> <br /> (b) The applicants must provide to the City and have approved a plan to <br />store, handle, and remove trash and garbage at the site. <br /> <br /> (c) All exterior renovations shall be submitted to the Downtown Design <br />Committee for review and approval. <br /> <br /> (d) The applicant shall lease two parking spaces in the Middle Street garage <br />or other closer parking facility in order to accommodate the parking needs of the <br />dwelling unit. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Pitts, Whitehurst, Holley <br />Nays: None <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Whitehurst, to adopt the following <br />resolution, approved at the October 9, 2001 meeting, and was adopted by the following <br />vote: <br /> <br />01-286(c): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO MOUNT CARMEL BAPTIST <br />CHURCH TO EXPAND A CHURCH AT 3310 DEEP CREEK BOULEVARD. <br /> <br /> WHEREAS, Mount Carmel Baptist Church has made application pursuant to <br />Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of <br />a use permit to expand its church at 3310 Deep Creek Boulevard, Portsmouth, Virginia; <br />and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That it finds that the use for which the permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> <br />
