<br />through June BOth, 1960 and can be terminated thereafter on 60 days written notice by either party.

<br /> 60-20 - 'I have iumerviewed.the members of the. Police Union who were present at
<br /> the Union meeting of September 2$th, 1959. Of the 41 present, 19 stated that they did not hear the remarks
<br /> between the Presiden~ of the Union and the Captain involved.
<br /> Prom the information I have been able to obtain, .there was quite a bit of
<br /> confusion at the time these remarks were alleged to have occurred. Of the 22 men who stated they heard remarks
<br /> made.between the.President and the. Captain, 16 stated that the Captain did no~ make the statemen~ as charged by
<br /> the Union Eepresen~ative; the President ,and 5.other men reported the statement was made as charged.
<br /> Prom the information I have obtained, it is my belief that this was en -
<br /> tirely~a Union matter and any remarks that were made had reference to Union activities and this incident should
<br /> have stayed within the U nion. I have no statement from any Policeman that substantiates intimidation or co-
<br /> ercion in thePolice Department."

<br /> "Comments on the Manager's Eep6rt o~ Investigation - Police Department Council
<br /> Meeting- January 26th, 1960.
<br />
<br />Mr. P~esident - I request that the Manager's report he spread upon the records of the Council.
<br /> ~entlemen, the 1/anace~. has made his report of the results of his investigation of the charges oi
<br />coercion and intimidation in ~he Police Department. The essence of his report is ~hat he has ~found no coercion
<br />or intimidation - or other 'irregularities.
<br /> It has been four months since th~ Manager was directed to investigate the charges of coercion
<br />and intimida{ion and any other improper activities of the Police Department. DUring that time much has halrgeued.
<br />The Chief has tendered his request for retirement and it has been held without action for six weeks. Finally
<br />on 16 December 1959 the press received and ~blished the Manager's statement that the Chief would be retained
<br />until ~arch 1960 at ~hich time he would he replaced by a retiring Marine Officer. This action c~onld indiate
<br />that there were no officers in[Lthe Police Department qualified for pre, me,ion to Chief. I am sure none of us
<br />woul~ accept that as the correc~ analysis. Therefore the ~/ana~er~ with knowledge that the Council would ~ot
<br />concur in the appointment of the 'Acting' Chief, wss forced to look for ~a replacement outside of the Depart-
<br />meat. This is in itself evidence of intimidation, no~ only within the Police Department, but of the ~Iauager
<br />himself.
<br /> The ohject of contention which .broqght the char~es of coercion, and intimidation to the surface
<br />was an ordinance which I had drafted af'~er extensive study. A copy of this proposed ordinance had been
<br />furnished by request to the President of the Police Association and was being presented to the body of that
<br />organization for their possible considerat~i~n and endorsement at the time, date and place indicated in the
<br />following affida~its:
