It has ~een approved by the Planningi Commission and attached hereto is a report of the viewers." without dissenting vote: On motion of Mr. Leary~ the following ordiBa$ce was approved on first reading "AN ORDINANCE TO CLOSE THAT SECTION OF GILViERTON BOULEVARD WHICH LIES NORTH OF THE NORTHERN LINE OF AFTON PARKWAY TO THE SOUTHERN LINE OF PARADISE CREEK, EXCLUDING THE PORTION OF OILNiERTON BOULEVARD NOW IN THE VICTORY BOULEVARD RIGHT OF WAY" The following report of the viewers was, on motion, received: "We, the undersigned, your duly appointed viewers in the matter of 'the closing of that section of Gilmerton Boulevard, which lies north of the northern line of Alton Parkway, to the southern line of Paradise Creek: (excluding the portion of Gilme~ton Boulevard now in the Victory B~ulevard right of way' met Jan. 14, 1961 for the purpose of viewing ssid portion of Gilm~ton $oulevard, certain related streets~ and the various lands adjoining subject area. We herewith respectfully submit our report of findings and opinions: (1). Your viewers found that- subject area of Gilmerton Boulevard is merely a platted, but unimproved street, ar presen~ overgrown with trees and underbrush and inaccessible to vehicular traffic. (~) We made an 'on site' inspection of the general area, using available maps and plats of said are~ that showed related streets as well as the location of adjoining property owners in relation to subject area of Gilmerton Boulevard. (3) After consultation, your viewers arrived at the unanimous opinzon that (s) the closing of subject area of Gilmerton Boulevard, would not result in any inconvenience to the general public or to any adjoining properEy owners; (b) normal ingress and egress to related pro- perties would not be impaired; (c) said closing would in no manner adversely affect normal traffic flow in the area. The Mayor ruled Mr. Walker out of order, quoting Section 2-11 of the City Code, Introduction of Ordinanqe after r~jection of similar one. After the Qouncil shall have finally rejected aR ordinance or resolution,another of substantially the same import shall no5 be placed on the docket by the clerk or enterta%ned by the Council unless two-thirds .of the membe~rs elected petition for same, before the expiration of three mont~s, Rfter which time such rejection shall have no effect thereon." Mr. Walker appealed from the decision of the Chair. Mr. Weiseman moved that the ruling of the Chair be.sustained.
