April llth, 1961 <br /> <br />Mr. Walker's motion to amend the ordinance as follows, was lost and by the following vote: <br /> <br /> "Section 2-3 (a) (6) "adding thereto "except Section 2.~3 {a)(6) from which shall be deleted <br />the words 'to the Sow water line' after the word extend" <br /> <br /> Section 3-2 (h) "adding thereto "except Section 3-2 (h) to which shall be added the <br />sentence 'Where conventional streets and lots exist _the arrangements, set back lines and other restrictions of <br />this ordinance shall apply.'" <br /> <br /> Section 3-3 "adding thereto "except Section 3-3 which shall read 'Any: non-conforming use <br />legally existing at the time-of the adoption of this ordinance, or whenever a~district is changed by an amend- <br />ment thereafter,, may~not~be changed foamy other non-conforming use unless a Use Permit is issued in accordance <br />with Section 4-2. Protests of surrounding .owners against such continuation, em ~change, of non-conforming uses <br />shall be processed under Section 8-1." <br /> <br /> Section 3-5 "adding thereto "except Section 3-5 to which the words 'and use' shall be <br />inserted between the word 'dimensional' and ~he- worj 'requirements' whereever the two are used together, and <br />from which the part of the sentence 'if any building,o= anytmrt thereof is remodeled or rebuilt to an extent <br />exceeding one third of its then reproducible value, exclusive of fou~kdation, as determined by the Building <br />Official,.or if any additions or new structures are erected' shall be deleted." <br /> <br /> Section 3-6 "adding gheretQ "except.Section 3-6 from which.the phrased'except.as provided <br />in Sections 3-3 through 3-9 inclusive' shall bedeleted." <br /> <br /> Section 3-9 "adding.thereto "except Section 3-9 .which shall read 'Nothing is this ordinanc~ <br />shall preven~ ~theQrdinary ~pkeep and r~epair necessary t~,maintain the structure ina safe and sanitary conditioy~"' <br /> <br /> Section 3-10 "adding thereto "except Section 3-10 to which shall be added the words 'ship <br />or boat repair yards' after the words 'junk yards.'" <br /> <br /> Section 3-11 "adding ~hereto "except Section 3=11 to which shall be added the following <br />words 'whAre conventiomal streets and ~ot~a~rangememts exist.'" <br /> <br /> Section 3-26 "adding thereto ~"exeapt Section-3-26 ~o which the following words shall be <br />added 'except~where coqvpntional street and lot armang~em~ts exist in which ~ase the dimensional requirements <br />for residences will apply.'" <br /> <br /> Section ~-2 "adding thereto "except Section 4-2 to which shall be added as th~ last <br />sub-section be~ore the Table of Uses, a new section: ] <br /> <br /> ( ) ~{case twenty percent-or more of the owners within three hundred feet of the boundarze~ <br />of the area for which Use Permi{s is applied, present a protest against ~the issuance of such permit, duly signed <br />and accompanied by the oath of the persQn procuring such signatures that he saw the owners sign such a protest, <br />,such ~se Permit shall not be granted except by nhafavorable ~vote-of six members of the City Cnuncil. <br /> <br /> Section 5-7 (~) "adding thereto "except Section 5-7 (n) which shall be changed to read <br /> '70 feet' in lieu of '80 feet'" <br /> <br /> Section 5-8 (k) "adding. thereto "except Section 5-8 (k) which shall be changed to read <br />'60 feet' in lieu of '80 feetTM. <br /> <br /> S~ction 6-3 adding t~ereto~ except Section 6-3 from which the last sentence starting <br />with the words 'It is further the intention - - shall be Jdeleted and the following sentence substituted there- <br />for 'Enforcement and interpretation of this o~ance shall be. in accomdance with .Chapter XIV Sectiom 2, of the <br />City Charter.
