FebrUarY 24~. 1998 <br /> <br />:31t <br /> <br />Financial Impact:* <br /> <br />· There will be minimal impact as the revisions bring our City Code into <br /> conformance with the State Code and our present practices. <br /> <br /> Motion by Mr. Robinett, and seconded by Mr. Martin, to adOpt the following <br />ordinance, and waS adopted by the following vote: <br /> <br /> "ORDINANCE TO AMEND CHAPTER 38 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTION 38-94 (a) THEREOF, <br />PERTAINING TO DISCONTINUING WATER SERVICE FOR FAILURE TO PAY <br />AND OTHER REMEDIES." <br /> <br />Ayes: Benn, Griffin, Martin, Pitts, Robinett, Holley <br />Nays: Clemons <br /> <br />98-38 - Adoption of an ordinance to close and vacate an alley in the block <br /> bounded by Arden Street on the north, West Norfolk Road on the south, <br /> Tyre Neck Road on the east and Grove Baptist Church on the west. <br /> <br />Recommendation: <br /> <br />Adoption of an ordinance to close and vacate an alley in the block bounded <br />by Arden Street on the north, West Norfolk Road on the south, Tyre Neck <br />Road on the east and Grove Baptist Church on the west. <br /> <br />Purpose and Need: <br /> <br />This is a paper alley, and the area proposed for closing is bordered on each <br />side by property of the applicants, Grove Baptist Church and Margaret S. <br />Riggins. <br /> <br />· The church has applied for the closing to facilitate the church's expansion <br /> plans. <br /> <br />Financial Impact: <br /> <br />· This property is likely to remain non-taxable.because the applicant is a <br /> church and is expected to qualify the property for tax exemption. <br /> <br />· The applicant would be required to pay the City $800 which is one half the <br /> assessed value assigned the area by the City Assessor. <br /> <br />· If the property were taxable, then the real estate taxes would equal $21.76 per <br /> year for this 16-foot alley, which consists of approximately 5,080 square feet. <br /> <br />1. James C. Hawks, 320 London Street, represented the applicant and provided <br /> information on the proposed alley closure. <br /> <br /> Motion by Mr. Martin, and seconded by Mr. Clemons, to adopt the <br />following ordinance, and was adopted by the following vote: <br /> <br /> "ORDINANCE CLOSING AND VACATING AN ALLEY BOUNDED BY ARDEN <br />STREET, WEST NORFOLK ROAD, TYRE NECK ROAD, AND GROVE BAPTIST <br />CHURCH." <br /> <br />Ayes: Benn, Clemons, Griffin, Martin, Pitts, Robinett, Holley <br />Nays: None <br /> <br /> <br />
