Host, Bureau of Fire <br />Prevention.)" <br /> <br />~o approve the application and <br /> <br />Mr. Pete Wnukoski spoke. <br /> <br />Motion of Mr. Barnes Eo concur in the recommendation of the Planning Commission <br />to adopt the following resolution, was adopted, without dissenting vole: <br /> <br />"WHEREAS, the City of Portsmouth, by its City Attorney, has <br />filed an application pursuan~ to Section 4-2 of the Zoning <br />ordinance of the City of Portsmouth,~1961, for the granting <br />of a use permit as hereinafter described; and <br /> <br />WHEREAS, Th8 applicant, the Planning Director and the City <br />Manager have done all things required ro he done in connection <br />with said application, and the Planning Commission has recommended <br />the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> A. That the use for which the use permit hereinafter described <br />is sought (1) will nog adversely affect the health or safety of <br />persons residing or working in the neighborhood of the proposed <br />use, (2) will not be detrimental to the public welfare or injurious <br />to propergy or improvements in the neighborhood, and (3) will be <br />in accord with the purposes of said Zoning Ordinance. <br /> <br /> B. That the City of Portsmouth is hereby granted a use permit, <br />pursuant ~o Section 4-2 of said Zoning Ordinance, for the construction <br />and operation of a garbage ~nd waste incinerator 5o be located in the <br />area bounded by the tracks of Seaboard AirLine Railroad Company, <br />Norfolk and Portsmouth Belt Line Railray and Atlantic and Danville <br />Railway. <br /> <br />Comprehensive Plan Document CP 2-62 and CP 2A-62 <br /> <br />The following letter from the Plannzng Commisszon was read: <br /> <br /> "At its regular monthly meeting od November 13, 1962, the City Planning Commission <br />conducted a public hearing on Comprehensive Plan elements CP 1-62, CP 2-62,'and CP 2A-62. <br /> These matters were fully discussed, and the Planning Commission unanimously resolved <br />ro recommend your approval of these elements in our Comprehensive Plan. <br /> It is 5o be noted that, with the exception of certain changes in suggested state <br />highway routes, your approval constitutes mere readoption of elements put to record in March under the provisions <br />of the old State Planning law which expired on June 30, 1962. <br /> The City Attorney advised the Planning Commission that it would be proper to have <br />all Comprehensive Plan elements officially adopted pursuant to the ter~s of the new State Planning law." <br /> <br /> Motion of Mr. Dillon ~o concur in the recommendation of the Planning Commission, <br />to approve, was adopted, without dissenting vole. <br /> <br />The following reports from the City Manager were read: <br /> <br /> 62-267 - "I submit the attached ordinance and recommend that it be placed on first <br />reading.' <br /> This amends Sections 9-12 and 9-13 of the Code of the City of Portsmouth, Virginia, <br />1961, to incorporate the National Electric Code as amended into the City Code. This is b~ing done ~o p~ovide <br />for the amendments made to the National Code s~nce the adoption of the City Code. This is the same type of <br />amendment as recently made concerning the Building Code." <br /> <br />On motion of Mr. Barnes, the following ordinance was approved on first reading: <br /> <br />AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1961, <br />BY AMENDING SECTION 9-12 SO AS TO ADOPT THE NATIONAL ELECTRICAL CODE, <br />1962, AND BY AMENDING SECTION 9-13 SO AS TO REQUIRE THAT COPIES OF THE <br />REQUIREMENTS OF THE CODE ADOPTED BY SECTION 9-12 BE MADE AVAILABLE TO <br />THE PUBLIC AT THE OFFICE OF THE CITY MANAGER. <br /> <br />reading. <br /> <br />62-268 - "I submit the attached ordinance and recommend that it be placed on first <br /> <br /> This amends the Code of the City of Portsmouth~ Virginim, 1961, to conform ro the <br />State law with regard to doing business on S~nday." <br /> <br />without dissenting vote: <br /> <br />On motion of Mr. Leary, the following ordinance was approved on first reading, <br /> <br />"AN ORDINANCE TO AMEND SECTION 19-68 OF THE CODE OF THE CITY OF <br /> PORTSMOUTH, VIRGINIA, 1961, PERTAINING TO THE OBSERVANCE OF <br /> SUNDAY AND THE WORK THAT MAY BE DONE ON SUNDAY SO AS TO CONFORM <br /> WITH THE STATE LAW ON THE S~B~ECT." <br /> <br /> 62-269 - "I submit the attached ordinance and recommend that it be placed on first <br />reading. <br /> <br /> <br />
