32:0 March 10, 1998 <br /> <br />The issues of toll locations and rates will be determined pending the <br />outcome of a decision on the acceptance of a public/private partnership <br />by the Commonwealth Transportation BOard. <br /> <br />Financial Impact: <br /> <br />This resolution does not commit any City funds for the project, <br />however; a portion of Portsmouth's State Urban Highway Funds will be <br />allocated for this project. <br /> <br /> Motion'by Mr. Clemons, and seconded by Mr. Robinett, to adopt the <br />following resolution, and was adopted by the fOllowing vote: <br /> <br /> "RESOLUTION SUPPORTING THE VIRGINIA DEPARTMENT OF <br />TRANSPORTATION'S PROJECT FOR THE CONSTRUCTION OF PINNER'S <br />POINT INTERCHANGE IN THE CITY OF PORTSMOUTH, VIRGINIA, <br />APPROVING THE PROPOSED LOCATION AND DESIGN FEATURES OF ~THE <br />INTERCHANGE, REQUESTING THE COMMONWEALTH OF VIRGINIA <br />DEPARTMENT OF TRANSPORTATION TO ACQUIRE ALL NECESSARY <br />RIGHT-OF-WAY, AND AUTHORIZING THE EXECUTION OF ALL <br />NECESSARY UTILITY AGREEMENTS, <br /> <br /> WHEREAS, the Virginia Department of Transportation (VDOT) is <br />proceeding with the Pinners Point Interchange and the City of <br />Portsmouth is supporting the implementation of this improvement with the <br />City's urban allocations; and, <br /> <br /> WHEREAS, a Design Public Hearing was held for the purpose of <br />presenting plans to and receiving comments from the public; and, <br /> <br /> WHEREAS, representatives from the City of Portsmouth were present <br />and participated in said hearing; and, <br /> <br />WHEREAS, the City of Portsmouth and VDOT agree that the amount of tolls <br />and location of the toll facilities cannot be finalized until the <br />Commonwealth Transportation Board decides whether to accept the <br />Public-Private Partnership proposal for the Pinners Point Interchange, <br />Midtown Tunnel, and Martin Luther King Freeway Extension projects, and <br />that further presentations by VDOT and actions by City Council will be <br />required on these issues. <br /> <br /> NOW, THEREFORE BE IT RESOLVED, that the Council of the City of <br />Portsmouth, Virginia, supports the Virginia Department of Transportation's <br />project for the improvement of the Pinners Point Interchange between the <br />Western Freeway, the Midtown Tunnel, and the Martin Luther King <br />Freeway,.a distance of approximately 1.5 miles in length and designated as <br />Project No. 0164-124-F01, PE-101, RW-201, C-501; and, <br /> <br /> BE IT FURTHER RESOLVED, that the Council of the City of <br />Portsmouth, Virginia, hereby approves the major design features of the <br />Pinners Point Interchange as identified at the public hearing on January 6, <br />1997 with the minor design changes as a result thereof, and: <br /> <br /> BE iT FURTHER RESOLVED, that the City of Portsmouth requests <br />the Virginia Department of Transportation to acquire all rights-of-way <br />necessary for the project in the name of the Commonwealth of Virginia at <br />the appropriate time, and; <br /> <br /> BE IT FURTHER RESOLVED, that the proper officers of the City are <br />hereby authorized to execute all necessary railroad and utility agreements <br />required in conjunction with the acquisition of such rights-of-way." <br /> <br />Ayes: Benn, Clemons, Griffin, Martin, Pitts, Robinett, Holley <br />Nays: None <br /> <br /> <br />
