March 10, '1998 <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter described is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons residing or <br /> working in the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or injurious to the property or <br /> improvements in the neighborhood; <br /> <br />(c) Will be provided with sufficient landscaping to insure compatibility with <br /> surrounding uses; <br /> <br />(d) <br /> <br />Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient <br />traffic movement; and <br /> <br />(e) Will be in accordance with the purposes of the City of Portsmouth <br /> Zoning Ordinance. <br /> <br />That Gateway Storage Associates is hereby granted a use permit <br />pursuant to Section 40-43.1 of the Code of the City of Portsmouth, <br />Virginia (1988) for the operation of a public storage facility on property <br />located near the intersection of Gateway Drive and Twin Pines Road, <br />and being more particularly described as: <br /> <br />UP-97-27 <br /> <br />3. That this use permit is approved subject to the following conditions: <br /> <br />(a) The project shall be constructed in accordance with the submitted Site <br /> Plan (Exhibit A), attached hereto and made a part hereof. <br /> <br />(b) In addition to the landscaping shown on Exhibit A, the applicant shall <br /> establish and maintain a Landscaping Group 3 vegetative buffer along <br /> the northern edge of the facility adjacent to the existing service station. <br /> The applicant and any subsequent operator shall also plant and <br /> maintain at least four medium-sized trees, as defined by the City, <br /> adjacent to Twin Pines Road. <br /> <br />(c) The building materials, fence and vegetative Screen shall match those <br /> employed in the existing facility. <br /> <br />(d) <br /> <br />The applicants shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local governments, and shall obtain and <br />maintain in effect all necessary licenses and permits. <br /> <br />(e) All real estate taxes, personal property taxes, and business license <br />taxes owed on or in connection with the property shall be timely paid. <br /> <br />4.
