March 10. 1998 317 UP-97-26 Beginning at a point 240'_+ south of the southwest corner of the intersection of Broad Street and Woodrow.Street; thence, west 140'_+ to a point; thence, south 80'_+ to a point; thence, east 140'_+ to a point; thence, 80'-+ to the point of the beginning. 3. That this use permit is approved subject to the following conditions: (a) Occupancy of the facility shall be limited to no more than fifteen (15) children. (b) No more than five (5) children under the age of 30 months may occupy the facility at the same time. Indoor hours of operation shall be limited to the hours of 6:00 A.M. through 6:00 P.M. Outdoor play hours shall be limited to the hours between 10:00 a.m. and 6:00 p.m. (d) The facility shall be inspected annually by the City's Fire Prevention Bureau, the Public Health Department, and the building Official, and the operator shall promptly correct any deficiencies noted. (e) The facility shall comply with all applicable codes, ordinances and regulations of federal, state and local governments, and the operator shall obtain and maintain in effect all necessary licenses and permits. (f) The project shall be developed in accordance with submitted site and floor plans as approved by the City. (g) Drop-off and pick-up of children shall be from the alley at the rear of the facility. (h) The use permit shall not be transferable. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council. Ayes: Benn, Clemons, Griffin, Martin, Pitts, Robinett, Holiey Nays: None Motion by Mr. Clemons, and seconded by Mr. Benn, to adopt the following resolution, approved on first reading at the February 24, 1998 Public Hearing meeting, and was adopted by the following vote: 98-36 (b) "A RESOLUTION GRANTING A USE PERMIT TO GATEWAY STORAGE ASSOCIATES FOR THE OPERATION OF A PUBLIC STORAGE FACILITY NEAR THE INTERSECTION OF GATEWAY DRIVE AND TWIN PINES ROAD. WHEREAS, Claude F. Lym has made application on behalf of Gateway Storage Associates, a Virginia general partnership, pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate a public storage facility (S.I.C. 422) to be located near the intersection of Gateway Drive and Twin Pines Road, Portsmouth, Virginia, as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions.
