March 10. 1998 <br /> <br />317 <br /> <br /> UP-97-26 <br /> <br /> Beginning at a point 240'_+ south of the southwest corner of the <br />intersection of Broad Street and Woodrow.Street; thence, west 140'_+ to a point; <br />thence, south 80'_+ to a point; thence, east 140'_+ to a point; thence, 80'-+ to the <br />point of the beginning. <br /> <br />3. That this use permit is approved subject to the following conditions: <br /> <br />(a) Occupancy of the facility shall be limited to no more than fifteen (15) <br /> children. <br /> <br />(b) No more than five (5) children under the age of 30 months may occupy the <br /> facility at the same time. <br /> <br />Indoor hours of operation shall be limited to the hours of 6:00 A.M. through <br />6:00 P.M. Outdoor play hours shall be limited to the hours between 10:00 <br />a.m. and 6:00 p.m. <br /> <br />(d) <br /> <br />The facility shall be inspected annually by the City's Fire Prevention <br />Bureau, the Public Health Department, and the building Official, and the <br />operator shall promptly correct any deficiencies noted. <br /> <br />(e) <br /> <br />The facility shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local governments, and the operator shall <br />obtain and maintain in effect all necessary licenses and permits. <br /> <br />(f) The project shall be developed in accordance with submitted site and floor <br /> plans as approved by the City. <br /> <br />(g) Drop-off and pick-up of children shall be from the alley at the rear of the <br /> facility. <br /> <br />(h) The use permit shall not be transferable. <br /> <br />REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council. <br /> <br />Ayes: Benn, Clemons, Griffin, Martin, Pitts, Robinett, Holiey <br />Nays: None <br /> <br /> Motion by Mr. Clemons, and seconded by Mr. Benn, to adopt the following <br />resolution, approved on first reading at the February 24, 1998 Public Hearing <br />meeting, and was adopted by the following vote: <br /> <br />98-36 (b) <br /> <br /> "A RESOLUTION GRANTING A USE PERMIT TO GATEWAY STORAGE <br />ASSOCIATES FOR THE OPERATION OF A PUBLIC STORAGE FACILITY NEAR <br />THE INTERSECTION OF GATEWAY DRIVE AND TWIN PINES ROAD. <br /> <br /> WHEREAS, Claude F. Lym has made application on behalf of Gateway <br />Storage Associates, a Virginia general partnership, pursuant to Section 40-43.1 <br />of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use <br />permit to operate a public storage facility (S.I.C. 422) to be located <br />near the intersection of Gateway Drive and Twin Pines Road, Portsmouth, <br />Virginia, as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of <br />said use permit with conditions. <br /> <br /> <br />
