19¸ <br /> <br />Juno 8th, 1965 <br /> <br />i..!ii .- 'i~'kN ORDIMANCE TO APPROPRIATE $5,841.00 FROM <br /> THE GENERAL CAPITAL IMPROVEMENT FUND FOR THE PURCHASE <br /> OF CITY CODE SUPPLEb~NTS" <br /> <br />On motionoof Mr. Leafy, the ordinance was adopted, and by the following vote: <br /> <br /> Ayes: Smith, Barnes, Dillon, Eastes, Johnson, Knight, Leafy <br /> Nays: None <br /> 65-121 - Motion of Mr. Barnes to go into the election of a member of the Planning Commission, to fill the <br /> vacancy created by the death of Damon Tatem, was adopted. <br /> Mr. Barnes nominated Hugh Johnston, #$ Loc~st~.%ar~;i~ On motion of Mr. Knight, nominations were closed. <br /> Vote being taken, Mr. Johnston was u~animdusly elected for the unexpired term of Damon Tatem, which term <br /> expires January 1, 1969~ <br /> NEW BUSINESS 65-158 - The following letter from the Planning Director was read: <br /> <br /> "At its regular monthly meeting on June 1, 1965, the City Planning Commission <br />completed work on its recommendations relative to this use permit ~Dplication of Diversified Investments, Inc. for <br />a trailer park in the M-1 zoning district at 2805 Victory Boulevard. In the process, the Commission fashioned <br />guidelines for review of such applications and resolved to spread them upon the minutes of its May 11, 1965, <br />meeting. The Planning Commission advances its recommendations in five distinct phases, as follows: <br /> <br /> 1. PLAT: As ~e first such proposal pursuant to the new Zoning Ordinance <br />of 1961, "TRAILER ACRES" leaves something t~'-~-~desired but will improve a deplorable situation and provide <br />tangible local experience. City Council final approval should be t~ddto this plat and other graphic documents <br />submitted by the applicant and certified by agents of City Council such as the City Manager and/or City Attorney. <br />Periodic review by municipal employees under the City Manager will involve this plat and other graphic documents. <br />The plat should be amended to ~how the "~.IaaNAGH~NT AREA" inside the cul-de-sac, dedication to the City of Portsmouthi<7~ <br />of astrip along geechdale Road for its widening (right-of-way) and the closure of Smithfield Road between Beechdale <br />Road and Victory Boulevard. See 5 below. <br /> <br />MANAGER falls into five categories: <br /> <br />2. ADDITIONAL GRAPHIC DOCUMENTATION THAT SHOULD BE SUPPLIED iTHE CITY <br /> <br />A. Utilities: <br /> <br />sanitary sewers and storm drainage construction plans; <br /> <br />acceptable to City Engineer. <br /> <br />B. Water: construction plans for water service acceptable to Water <br /> <br />Department Director. <br /> <br />C. Lighting: constructionpplans for service acceptable to City Traffic <br /> <br />Engineer. <br /> <br />D. Screening: planting plan acceptable to City Engineer. <br /> <br /> E. Dev~lgp~t ~lans: relative to 'internal roadways', the playground <br />and other physical improvements acceptable to City Enginee'r hnd Building Official. <br /> <br /> 3. REALIC~IMENT OF BEECHDALE ROAD AT VICTORY BOULEVARD: The Planning <br />Commission resolved to recommend one of two actions: 'either the w~en~ng of Smithfield Road to provide a standard <br />rightrof-way, or the realignment of Beechdale Road at Victory Boulevard on a projected centerline of Kent Drive <br />and the vacationcof Smithfield Road between Beechda~e Road and Victory Boulevard; a matter left finally to the <br />various technicians involved. The City Engineer, Traffic Engineer and Planning Director jointly recommend the <br />latter course of action -- a widened Beechdale Road sharing the projected centerline of Kent Drive at Victory <br />Boulevard and the closing of Smithfield Road between Beechdale and Victory. If you concur with this Planning <br />Commission recommendation, a plat showing this improvement should be prepared as a basis forlnecessary deed <br />transfers and a street closure ordinance. The Planning kommission does not feel that this trailer park use.permit <br />applicant is involved in any physical street improvement related to this realignment. <br /> <br /> 4. PERIODIC REVIEW OF 'INTERNAL ROAIg~AYS' AND OTHER PHYSICAL IMPROVEMENTS: <br />In its agreement with the applicant, City Council shouf8' gran~' this use permit for a specific ~erio~" of time; <br />twenty years is a time period used in other use permits. During this period, the agreement should specify that ~ ~: <br />agents of the City Manager (such as the City Engineer and Director of Public Health) are instructed ~nd authorized <br />to enter upon the premises not less than once a year for purposes of determining that maintenance of the required <br />improvements is being pursued and that the trailer park is being operated in a fashion condusive to the health <br />and welfare of the City of Portsmouth. Any finding, to the contrary brought to the attention of the City Manager <br />would be reported to City Council which could then inquire of the owner why this use permit should not be revoked. <br /> <br />5. RESTRICTIONS: <br /> <br />A. Not more than one trailer per designated space. <br /> <br /> B. Responsibility of the owner of record to maintain 'internal <br />roadways', lighting, sewers, storm drains, planting screens and other ~hysical improvements and to be responsible <br />therefore to the extent of reasonable maintenance and the conditions imposed by the use permit. <br /> <br /> C. Area covered by this use permit to be used only for trailer park <br />residential purposes during the specified approval period; related uses may, of course, be maintained by the owner <br />of record in the "MANAGEb~NT AREA". There will be no billboards erected in the trailer park area, but an entrance <br />sign on Victory Boulevard would be permitted." <br /> <br />on July 13th, 1965. <br /> <br />On motionof ~,.
