July 15, 196S Motion of Mr. Johnson to concur in the recommendation of the City Manager, was adopted, without dissenting vote. 6S-179 - "I submit the attached ordinance and recommend that it be placed on first reading. This closes a portion of Westmoreland Avenue between Westmoreland Terrace and Western Branch of the Elizabeth River. - This closing has been requested by the adjacent property owners and a report of the viewers appointed by the City Council is attached hereto." · On motion of Mr. Barnes, the following ordinance was approved on first reading, without dissenting vote: ,AN ORDINANCE TO CLOSE THAT PORT:ION OF WEST~DRELAND AVN~JE LYING BETWEEN WESTMOREL~ND TERRACE AND THE WESTERN BRANCH OF THE ELIZABETH RIVER" The following report of viewers was presented and, on motion, was received: The undersigned, viewers appointed by the Council of the City of Portsmouth purusant to a resolution adopted at its regular meeting June 22, 1965, did on the 29th day of ~une, 196S, convene in an area set forthin the resolution~m~d examined the street proposed to be Closed. It is the opinion of the viewers that no inconvenience will be caused to the public in the discontinuance and vacation in the street as set forth in the resolution. Y~ar vi~ers therefore recommend that the requested discontinuance and vacation of the street as set forth in the resolution be concurred in by the City ~ouncilo Charles R. Lively G. D. Meginley J. V. This amends the sales tax ordinance to allow a reciprocity agreement ~etween Tidewater cities adopting a similar ordinance with reference to the use tax. The purpose of this Ordinance is to eliminate the complex bookkeeping problem which the merchants are facing tax. not have to keep a record of sales tax having to keep individual books for each city concerning the sales Nith the adoption of this ordinance, the merchants in Portsmouth will for other cities having adopted a similar ordinance. They will pay directly to the City all sales taxes collected." On motion of Mr. Johnson. the following ordinance was approved on first reading, without dissenting vote: "AN ORDINANCE TO AA~ND THE CITY OF PORTSB~UTH, VIRGINIA, RETAIL SALES AND USE TAX ORDINANCE, BY ADDING THERHTO A NEW SECTION NUMBERED 17.1 PROVIDING THAT NOT~JITHSTANDING ANY OTHER PROVISIONS OF SAID ORDINANCE THE SALES TAX SHALL BE COLLECTHD ON EVERY NON-EXHMPT SALE WITHOUT REGARD TO THE ?
