<br /> 65-245 - "I submit the attached ordinance and recommend that it be placed on first
<br />reading. This prohibits the construction of electrically charged fences within the City Limits.
<br /> This type fence is primarily designed for use in Mural areas, but recently
<br />a few have been installed within the City in congested areas.
<br /> We have received many complaints from neighbors concerning the installation
<br />of'these fences, and it is felt that they should not be allowed."

<br />On motion of Mr. Eastes, the following ordinance was approved on first reading, without

<br />"AN ORDINANCE TO AMF:ND THE CODE OF THE CITY OF PORTSMOUTH,
<br />VIRGIN IA, 1961, BY ADDING THERETO A NEff SECTION NUMBERED
<br />$1-18.1, ~AKING IT UNLAWFUL TO CONSTRUCT OR F~AINTAIN AN
<br />ELECTRICALLY CHARGED FEMCE WITHIN THE CITY"

<br /> 65-246 - "I submit the attached ordinance and recommend that it be placed on first
<br />reading. This appropriates $5,661.74 for the payment of back taxes on parcels of land which have been
<br />acquired by the City.
<br /> These taxes cover submerged land located at Swimming Point, at the foot
<br />of Dinwiddie and Court Streets, and one lot on Riverview Avenue.
<br /> The main purpose of this appropriation is to clear the books of the Delinquent
<br />Tax Collector."

<br /> On motion of bit. Johnson, the following ordinance was approved on first reading,
<br />without dissenting vote:
<br />
<br />"AN ORDINANCE TO APPROPRIATE $5,661.74 FROM THE GENERAl
<br />FUND FOR PAYMENT OF BACK TAXES ON VARIOUS PARCELS OF LAND
<br />WHICH HAVE BEEN PURCHASED BY THE CITY"
<br />
<br /> 65-247 - "I submit the attached ordinance and recommend that it be placed on first
<br />reading. This additional $80,000 covers the cost of completing the interim pier facilities at Pinners
<br />Point, leased from the Virginia State Ports Authority.
<br /> It was found that additional work was necessary on the remodeling of
<br />the pier, as well as additional dredging. It was also necessary to construct a longshoremen's building,
<br />as well as haul fill material for the back-up storage."

<br />"AN ORDINANCE TO APPROPRIATE $80,000.00 FROM THE GENERAL
<br />CAPITAL IMPROVES~NT FUND FOR THE PURPOSE OF REMODELING
<br />A PIER AT PINNBRS POINT."

<br /> 65-248 - "I submit the attached resolution and recommend its adoption. This resolution
<br />authorizes the City Manager to file an application with the Housing and Home Finance Agency for an open-
<br />space grant in the amount of $150,000.
<br /> The purpose of this grant is to acquire property inr~Nansemond County to be
<br />developed for a city park, with all types of recreational facilities."

<br />On motion of Mr. Johnson, the following resolution was unanimously adopted:

<br />RESOLUTION AUTHORIZING FILING OF APPLICATION FOR GRJLNT
<br /> TO ACQUIRE OPEN-SPACE LAND
<br />
<br /> WHEREAS, Title VII of the Housing Act of 1961 provides for the making of grants by
<br />the Housing and Home Finance Administrator to States and local public bodies to assist them in the
<br />acquisition of permanent interests in land for open-space purposes where such acquisition is deemed
<br />essential to the proper long-range development and welfare of urban areas in accordance with plans for
<br />the allocation of land to such purposes; and
<br /> WHEREAS, the City of Portsmouth, Virginia, desires to acquire the fee simple interest
<br />to certain land~.known as the Obici Farm, which land, in accordance wish the Co~rehensive Plan adopted
<br />by the Council of the City of Portsmouth, Virginia, is to be held and used for permanent open-space
<br />land for recreational purposes; and
<br /> WHEREAS, Title VI of the Civil Rights Act of 1964, and the regulations of the Housing
<br />and Home Finance Agency effectuating that Title, provide that no person shall be discriminated against
<br />because of race, color, or national origin in the use of the land proposed to be acquired; and
<br /> WHEREAS, it is estimated that the total consideration to be paid for the acquisition
<br />of said interest will be $500,000.00:
<br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PORTSMOUTH, VIRGINIA,
<br />AS FOLLOWS:
<br />
<br /> 1. That an application be made to the Housing and Home Finance Agency for a grant
<br />in an amount authorized by Title VII of the Housing Act of 1961, which amount is presently estimated
<br />to be $150,000.00, and that the City of Portsmouth, Virginia, will pay the balance of the Consideration
<br />for the acquisition of such interest and the total of all related costs from other funds available to it.
<br /> 2. That the City Manager is hereby authorized and directed to execute and file such
<br />application with the Housing and Home Finance Agency, to provide additional information and to furnish
<br />such documents as may be required by said Agency, to execute such contracts as are required by said Agency,
<br />arid to act as the authorized co~respondent of the City of Portsmouth, Virginia.
<br /> 5. That the proposed acquisition is in accordance with the Comprehensive Plan adopted
<br />by the Council of the City of Portsmouth, Virginia for the preservation of permanent open-space ~and, and
<br />that should said grant be made, the City of Portsmouth, Virginia, will retain said land for thee:use
<br />designated in said application and approved by the }lousing and Home Finance Agency.
