<br /> On motion of Mr. Leery, the following ordinance was approved on first reading, without dissenting
<br />vote:

<br /> "AN 0RDINFJNCE TO ~!END SECTION 6-14 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1951,
<br />PERTAINING TO RRICES ~%ND CHARGES FoR WORK DONE IN CITY CEmeTERIES"
<br />
<br /> 67-50 - "I submit the attached resolution and recommend its adoption. This authorizes the
<br />condemnation of property at the southeast corner of Columbia and Crawford Streets.
<br /> The property is needed in connection with the development of the Civic Center, and we have
<br />been unable to reach an agreement on the price with the owner."
<br />
<br /> On motion of Mr. Castes, the following resolution was adopted, without dissenting vote:
<br /> "A RESOLUTION TO PROVIDE FOR THE ACQUISITION 'OF CERTAIN PROPER'fi BY THE CITYOF PORTSMOUTH UNDER
<br />EMINENT DOMAIN PROCEEDINGS PURSUANT TO CHAPTER 229 OF THE ACTS OF ASSEMBLY OF 1966, SAID PROPERTY BEING
<br />NECESSARY TO PROVIDE A PART OF THE SITE FOR THE CIVIC CENTER
<br />
<br /> WHEREAS, the City of Portsmouth is constructing a Civic Center consisting of several buildings
<br /> in which will be ~ocated various governmental offices, agencies and departments and the various courts
<br /> of the City; and
<br /> WHEREAS, the City of Portsmouth has found it to be necessary to acquire the interest hereinafter
<br /> specified in and to the hereinafter described narcel of land situate in the City of Portsmou~l, Virginia,
<br /> for the purpose of constructing the aforesaid buildings and providing the yard spaces for use therewith; and
<br /> ~%'IIEREAS, the City of Portsmouth has not been able to nurchase the nroperty described herein, necessary
<br />to the project, because the owners thereof and the City ha~e not been able to agree upon the price to be
<br />paid therefor; and
<br /> ~VHEREAS, advancement of the wo~k and~ occupancy of said buildings will be delayed unreasonably if the said
<br />property is not made available as soon as possible.
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br /> Section 1. The City Attorney is directed to institute eminent domain proceedings, employing special
<br />counsel for that purpose if he deems it advisable, against the property hereinafter described for the
<br />purpose of acquiring fee ~imple title therein, in accordance with and nursuant to Section 2S(F) of the Charter
<br />of the City of Portsmouth (Chapter 229 of the Acts of Assembly of 1966~, and to deposit to the credit of
<br />the court as provided by law the sum hereinafter specified to compensate the owners of the said property.
<br /> Section 2. The property to be acquired is described as foll~ws:
<br /> All that certain lo~, piece or parcel of land, with the improvements thereon, situate,
<br /> lying and being in the City of Portsmouth, Virginia, bounded and described as follows,
<br /> to-wit: Beginning at the Southeastern intersection of Crawford and Columbia Streets;
<br /> thence running south along the east side of C~awford Street 24 feet, more or less, to the
<br /> center line of the partition wall between the building hereby conveyed and the building
<br /> adjoining the same on the south; thence east along the center line of the said partition
<br /> wall 90 feet, more or less to the center line of the partition Wall between the buildings
<br /> hereby conveyed and the building adjoining the same on the East; thence north along the
<br /> center line of said last mentioned partition wall 24 feet, more or .less, to the south side
<br /> of Columbia Street and thence west along Columbia Street 90 feet, more or less, to Crawford
<br /> Street at the point of beginning.
<br /> Section 3. The owners of the aforesaid property are Milton Dorm and Rreda F. Dorm, and/or
<br />Allen Furniture Co., Inc.
<br /> Section 4. The amount to be deposited with tile court is Eight Thousand Two Hundred ($8,200.00)
<br />Dollars."

<br /> 67-51 - "The Portsmouth School Board has requested authorization to exceed its budget in the
<br />a-mount of Pederal funds received from Federa%progr~ms which are not already budgeted.
<br /> This covers special programs for ~hich Federal funds are received and will not increase
<br />local costs.
<br /> I recommend that the School Board be authorized to expend these Federal funds."

<br /> ~tion of Mr. Johnson to concur in the recommendation of the City Manager was adopted, without
<br />dissenting vote.

<br /> 67-27 - The following ordinance, approved on first reading at last meeting, was taken up and read:
<br /> "AN ORDINANCE TO APPROPRIATE $3S,910.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR THE PURCHASE
<br />OF PROPERTY AT 136 AND 254 SEABOARD AVENUE ;~ND 203, 219 ;aND 221 HILL AVENUE IN PIN~ERS POINT"
