<br /> WHEREAS, the City of Portsmouth has not been able to purchase the property described herein,
<br />necessary to the project, because the o~mers thereof and the City have not been able to agree upon
<br />the price to be paid therefor, or the City has not been able to locate certain of the o~ers or
<br />because of the status of the title of certain parcels of the property; and,
<br />
<br /> }~iEREAS, advancement of the work and use of said State Highway Route 141 will be delayed
<br />unreasonably if the said property is not made available as soon as possible.
<br />
<br /> Virginia.
<br />NOW, TMEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, ' ' ' ·
<br />
<br /> Section 1. The City Attorney is directed to institute eminent domain proceedings, employing special
<br />counsel for that purpose if he deems it advisable against the property hereinafter described located
<br />along State Highway Route 141, for the purpose of acquiring fee simple title therein, except parcel
<br />S1 in which a temporary construction easement is to be acquired, in accordance with ahd pursuant to
<br />Section 23 (F) of the Charter of the City of Portsmouth (Chapter 229 of the Acts of Assembly of
<br />1966), and to deposit to the credit of the court as provided by law the sum hereinafter specified to
<br />compensate the respectiv~ owners of the various parcels of land, as shovm on those certain plans entitled
<br />0141-12~-101, R/W 201, dated May 6, I966, sheets 3, 4, 6 and 8, a copy of which is filed with the
<br />Department of Public Works of the City of Portsmouth, Virginia:

<br /> Section 2. The City Attorney is authorized to eroceed against each individual oarcel and the
<br />respec%ive owners thereof or against such combinati6ns of parcels and the respective owners thereof as
<br />he shall deem advisable."

<br /> 67-114 - "I submit the attached resolution and recommend its adoption. This requires a property
<br />owner at 1009 Effinghgm Street to remove steps encroaching on the right-of-way.
<br /> This is necessary as we have been unable to get the property owner to coooerate with the
<br />City for the removal of the steps.
<br /> The resolution will give the City a.uthority to remove the steps, as well as place a
<br />penalty on the property owner if they are not removed."

<br />On motion of ~{r. King, the following resolution was adopted, without dissenting vote:

<br />"A RESOLUTION TO PROVIDE FOR THE REMOVAL OF CERTAIN STEPS ENCROACHING UPON EFFtNG!~M IN THE CITY
<br />OF PORTSI~UTH, VIRGINIA, PURSUANT TO CHAPTER III SEGFION 30 OF THE CITY CI4~RTER OF THE CITY OF
<br />PORTSMOUTH, VIRGINIA (Acts 1908, Chapter IS7), SAID REMOVAL BEING NECESSARY TO THE SAFETY DF
<br />THE PUBLIC.
<br />
<br /> WHEREAS, the front steps of those certain premises known and designated as 1009 Effinkham Street,
<br />Portsmouth, Virginia~ encroach upon the right of way of the said streets, and
<br />
<br />~qHEREAS, the aforementioned steps as uhe~ are presently situate create a hazard to ~he public; and
<br />
<br /> WHEREAS, Iffebster Watts and Vivian L. Watts have been requested to remove the said steps on numerous
<br />occasions, but have failed and refused to do so.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, pursuant to
<br />Chapter III Section 30 of the City Charter of the City of Portsmouth, Virginia (Acts 1908, Chapter 157):

<br /> Section 1. The City Manager or his authorized representative is directed to order the said Webster
<br />Watts and Vivi~n L. Watts no remove the =~ of the premises known and designated as 1009
<br />Effingham Street, Portsmouth, Virginia, encroaching unon the street right of way within ten days from
<br />the date of the adoption of this resolution.
<br />
<br /> Section 2. Upon the failure of the steps to be removed as aforesaid, the Director of Public
<br />Works of the City of Portsmouth or his atrthorized representative is hereby authorized and directed
<br />to remove the same with all reasonable charges, with costs, to be collected from the owners of the
<br />said premises by the same process in which taxes are collected."
<br />
<br /> 67-115 - "I submit the attached resolution and recommend its adoption. This authorizes the
<br />submittal of a Model City Application to the Department of Mousing and Urban Development.
<br /> It is necessary that this application b~ submitted by May 1, 1967."
<br />
<br />On motion of Mr. Knight, the following resolution was. adopted, without dissenting vote:

<br />"RESOLUTION OF THE COUNCIL OF THE CITY OF PORTSMOUTH ~PROVING REOUEST FOR FIN~MCIAi
<br />ASSISTANCE TO PLI~ AND DEVELOP A CO~fPREHENSIVE CITY DEP0~NSTRATION PROGR~
<br />
<br /> WHEREAS, the City of Portsmouth desires to undertake a comprehensive program to ~ebuild or
<br />revitalize large slum and blighted areas and Eenerally imorove living conditions for the people
<br />who live in such areas; and
<br />
<br /> WHEREAS, the Secretary of Housing and Urban Development is authorized to make 8rants to, and
<br />contract with~ city Demonstration Agencies to pay 80 per cent of the costs of planning ~nd developing
<br />such city Demonstration programs:
