-10 At a Regular Meeting of the City Council on Tuesday, July 14, 1~, there were present: Vice Mayor Bernard D. Griffin, Sr.~, Cameron C. Pitts, P. Ward Robinett, Jr., J. Thomas Benn Ill, William E. Moody, Jr., Charles B. Whitehurst, Sr., City Manager Ronald W. Massie City Attorney G. Timothy Oksman. Councilman Pitts opened the meeting with prayer, which was followed by the Pledge of Allegiance to the Flag. Vice Mayor Griffin called the meeting to order and welcomed all in attendance. Motion by Mr. Robinett, and seconded by Mr. Pitts, to approve the minutes of a Called Meeting on June 23, 1998, a Regular Meeting on June 23, 1998, and a Called Meeting on July 1, 1998, and was adopted by unanimous vote. - PUBLIC HEARING - 98-162 Public hearing on a use permit, code amendment, and a street closure application: ' . (a)UP-98-06 pRENTIS PARK/BRIGHTON NEIGHBORHOOD - L. Louise Lucas requests a use permit to construct and operate an assisted living facility at 1819-1827rEIm Avenue. 1. Yvonne Cleveland, 1731 Maple Avenue, spoke in opposition to the use permit. 2. Richard Cleveland, 1731 Maple Avenue, spoke in opposition to the use permit. 3. Raleigh Harsley, 2124 Peach Street, spoke in opposition to the use permit. 4. Gloria Askew, 1805 Elm Avenue, spoke in opposition to the use permit. 5. William Copeland, 2701 Staunton Avenue, questioned if~facility would house females and males, and if facility would be integrated. 6. Joseph Mills, 1015 College Street, spoke in opposition of the use permit. 7. Eliza Simons, 1806 Prentis Avenue, spoke in opposition of the use permit. . Motion by Mr. Pitts, and seconded by Mr. Moody, to concur with the recommendation of the Planning Commission that UP.98-06 be approved on first reading, and was adopted by unanimous vote. (Mr. Robinett abstained as his place of employment (BB&T) is financing this project.) (b)CA-98-03 ClTYWIDE ~ The City of Portsmouth requests an amendment of the Use Schedule for Commercial and Industrial Zoning Districts of the Zoning Ordinance to allow commercial shellfish ~establishments to ,operate in Waterfront (W-l) districts with approval of a conditional use permit. Motion by Mr. Benn, and seconded by Mr. Pitts, to concur with the recommendation of the Planning Commission that CA-98-03 be approved on first reading, and was adopted by unanimous vote.
