<br /> Motion of Mr. Knight to concur in the recommendation of the City Manager was adopted, without
<br />dissenting vote.
<br />
<br /> 67-128 - "I submit the attached deed of easement and recommend that tile proper city officials be
<br />authorized to sign. This, in effect, is an exchange of easements.
<br /> There is presently an easement running across Lot 5, Block 50, Plat of Cradock, over
<br />which a house has been constructed, The property owner is granting a new drainage easement in order
<br />that the one running under the house can be abandoned by the City.
<br /> This has been approved by the City Attorney."
<br />
<br /> Motion of Mr. King to concur in the recommendation of the City Manager was adopted, wie-hout
<br />dissenting vote.
<br />
<br /> 67-129 - "I submit the attached resolution and recommend its' adoption.
<br /> This requires a property owner living at 2400 Effingham Street to remove a porch
<br />encroaching on the right-of-way. Should the property owaer not remove the porch, this gives th~
<br />City authority to remove the porch and have the cost assessed against the property.
<br /> It is necessary that this porch be removed for the improvements to be made to
<br />EffinghamStreet in the very near future."

<br />On motion of Mr. Leafy, the following resolution was adopted, without dissenting vote:
<br />
<br />"A RESOLUTION TO PROVIDE FOR THE REMOVAL OF A CERTAIN PORCH ENCROACHING UPON EFFINGHAM STREET
<br />IN THE CITY OF PORTSMOUTH, VIRGINIA, PURSUANT TO CHAPTER III SECTION SO OF THE CITY CHARTER OF THE
<br />CITY OF PORTSMOUTH, VIRGINIA (Acts 1908, Chapter 157), SAID REMOVAL BEING NECESSARY FOR THE
<br />WIDENING AND IMPROVEMENT OF STATE HIGHWAY ROUTE 141 AND FOR THE SAFETY OF THE PUBLIC.
<br />
<br /> P~HEREAS, the front porch of those certain premises known and designated as 2400 Effingham Street,
<br />Portsmouth, Virginia, encroaches upon the right of way of the said streaK; and
<br />~HEREAS, the aforementioned porch as it is presently situate creates~a~:hazard to the public; and
<br />WHEREAS, Helen E. Tyson who resides at 2400 Effingham Street~ Portsmouth, Virginia, Gloria T.
<br />McDonald who resides at 821E. 9th Street, Flint, Michigan and Albert L. Tyson who resides at 710 N.
<br />6th Street, Richmund, Virginia, and parties unknown, the heirs of William Tyson are the owners of
<br />the said premises; and
<br /> WHEREAS, the said Helen E. Tyson, Gloria T. McDonald and Albert L. Tyson ha~e been requested
<br />to remove the said porch on numerous occasions, but have failed and refused to do so.
<br />NOW, THBREFORE, BB IT RESOLVED by the Council of the City of Portsmouth, Virginia, pursuant to
<br />Chapter III Section 50 of the City Charter of the City of Portsmouth, Virginia (Acts 1908, Chapter 157):
<br /> Section 1. The City Manager or his authorized representative is directed to order the said
<br />Helen E. Tyson, Gloria T. McDonald and Albert L. Tyson to remove the front porch of the premises known
<br />and designated as 2400 Effingham Street, Portsmouth, Virginia, encroaching upon the street right
<br />of way within ten days from the date of the adoption of this resolution.
<br /> Section 2. Upon the failure of the porch to be removed as aforesaid, the Director of Public ~orks
<br />of the City of Portsmouth or his authorized representative is hereby authorized and directed to
<br />remove the same with all reasonable charges, with costs, to be collected from the owners of t-he
<br />said premises by the same process in which taxes are collected."
<br />
<br /> 674130 - "I submit the attached ordinance and recommend that it be placed on first reading. This
<br />appropriates $8,700 for the purchase of a part of lot 48 on Seaboard Avenue and Lots 207 a~d 209 on
<br />Pinners Avenue in Pinners Point.
<br /> The property on Seaboard Avenue is tax delinquent property and is being acquired through
<br />a tax sale. The property on Pinners Avenue is being purchased from the owner.
<br /> This property will be used in the development of the Pinners Point Marine Terminal."
<br />
<br /> On motion of Mr. Knight, the following ordinance was approPed on first reading, without dissenting
<br />vote:
<br /> "AN ORDINANCE TO APPROPRIATE $8,700.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR THE PURCHASE
<br /> OF A PART OF LOT 48, SEABOARD AVENUE, LOTS 207 AND 209, PINNHRS AVENUE IN PINNERS POINT"

<br /> 67-75 - The following ordinance approved on first reading at last meeting on April 25, 1967,
<br />was taken up and read:

<br />"AN ORDINANCE TO REVISE, REARRANGE AND AMEND THE GENERAL ORDINANCES OF THE CITY OF
<br />PORTSMOUTH, RELATING TO THE SPECIFIC USES OF THE PREMISES IN THE VARIOUS ZONING DISTRICTS
<br />OF THE CITY OF PORTSMOUTH AND TO THAT END TO AMEND THE ZONING ORDINANCE OF THE CITY OF
<br />PORTSMOUTH 1961, BY AMENDING SECTION 4-5, THEREOF AND BY ADDING THERETO NE~ SECTIONS
<br />NUMBERED 4-4, 4-S, 4a6) 4-7, 4-8, 4-9, 4-10, 4-11, 4-12 and 4-15"

<br /> In this connection the following letter, addressed to the Mayor, was read:
