<br />"A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY OF
<br />PORTSMOUTH UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO CHAPTER 229 OF THE ACTS OF
<br />ASSEMBLY OF 1966, SAID PROPERTY BEING NECESSARY FOR THE CONSTRUCTION, WIDENING AND
<br />IMPROVE~,fl~NT OF STATE HIGH~AY ROUTE 58 FROM THE INTERSECTION OF AIRLINE TURNPIKE AND
<br />HIGH STREET TO THE INTERSECTION OF LONDON AND EFFINGIiAM STREETS.
<br />
<br /> /%~EREAS, in cooperation with the Federal and State governments, State Highway Route 58 is
<br />being constructed, widened and improved from the intersection of Airline Turnpike and High
<br />Street to the intersection of London and Effingham Streets in the City of Portsmouth, Virginia; and
<br /> WHEREAS, one of the obligations of the City of Portsmouth with respect to said project is the
<br />provision of the land necessary for the construction; and
<br /> WHEREAS, the City of Portsmouth has found it to be necessary to acquire the interest
<br />hereinafter specified in and to the hereinafter described parcels of land situate in the City of
<br />Portsmouth~ Virginia, for the purpose of constructing, widening and improving the aforesaid State
<br />Highway Route 58; and
<br /> WHEREAS, the City of Portsmouth has not been able to purchase the property described herein,
<br />necessary to the project, because the owners thereof and the City have not been able to agree upon the
<br />price to be paid therefor, or the City has not been able to locate certain of the owners or because
<br />of the status of the title.-of certain parcels of the property.
<br /> NOW, TM£REFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br /> Section 1. The City Attorney is directed to institute eminent domain proceedings, employing
<br />special counsel for that purpose if he deems it advisable against the property hereinafter described
<br />located along proposed State Highway Route 58, for the purpose of acquiring fee simple title ~herein,
<br />in accordance with Ithd pursuant to Section 25(F) of the Charter of the City of Portsmouth (Chapter 229
<br />of the Acts of Assembly of 1966), the various parcels of land being as shown, on those certain
<br />nlans entitled Proj. 0058-124-102, R~lq 201 and 202, dated February 14, 1966, Sheets 18, 19, 21, and
<br />22, a copy of which is filed with the Department of Public Works of the City of Portsmouth, Virginia:

<br /> Section 2. The City Attornay is authorized to proceed against each individual parcel and the
<br />respective owners thereof or against such combination of parcels and the respective owners thereof
<br />as he shall deem advisable."
<br />
<br /> 67-189 - "I suhmit the attached resolution and recommend its adoption.
<br /> This resolution is to be submitted to the ~irginia Department of Highways requesting
<br />them to consider designating a oortion of Victory Boulevard between routes 17 and 337 as part
<br />of the primary system of highways.
<br /> This is being requested in order that the City can receive assistance for improvements
<br />to this highway."

<br />On motion of Mr. King, the following resolution was adopted, without dissenting vote:
<br />
<br />"A RESOLUTION PERTAINING TO THE DESIGNATION OF VICTORY BOULEVARD BE~VEEN ROUTE 17 AND
<br />ROUTE 337, A FEDERAL AID HIGI~AY.
<br />
<br /> WHEREAS, Victory Boulevard between Route 17 and Route 337 lies within the City of Portsmouth,
<br />Virginia, and
<br /> }fdEREAS, the said section of highway connects the United States Naval Ammunition Depot and the
<br />Norfolk Naval Shipyard, and
<br /> WHEREAS, ~he ~nited States Ammunition Depot has its sole points of access upon the said
<br />seciion of Highway, and
<br /> WHEREAS, the said section of highway constitlrtes a major artery of the highway system within
<br />~he City of Portsmouth, and
<br /> WHEREAS, it is the desire of the City of Portsmouth to have Victory Boulevard, as aforesaid,
<br />designated a Federal Aid Highway.
<br /> NO}i, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br /> Section I. The City Manager is directed to Petition the State Highway Commissionerof the
<br />State of Virginia to have Victory Boulevard between Route 17 and Route 337, Portsmouth, Virginia,
<br />designated a Federal Aid Highway."
<br />
<br /> 67-190 - "I recommend I be authorized to make adjustments in the Revenue and Expenditures
<br />estimate of the 1966-67 budget; as submitted by the City Auditor."
<br />
<br /> Motion of Mr. Knight to concur in the recommendation of the City Manager was adopted, without
<br />dissenting vote.
