June 27, 1967 <br /> <br />At a regular meeting of the City Council, held on June 27, 1967, there were present: <br /> <br />R. IM¥i~e Smith, Jack P. Barnes, George D. Eastes, Burrell R. Johnson, Isaac W. King, L. L. Knight, <br />W. T. Leafy, A. P. Johnson, Jr., City Manager, Lee Morris and Robert Bray, attorneys, and <br />R. D. Ottavio, City Auditor. <br /> <br /> The meeting was opened with prayer by the Rev. David H. LaMotte, Pastor, St. John's Episcopal <br />Church. <br /> <br />Minutes of meeting held on June 15, 1967, were read and approved. <br /> <br />67-185 - The following public hearing on zoning was held: <br /> <br />Petition Z 67-5 - Area 1 ~ Pinners Point <br /> <br />No one spoke in regard to the petition. <br /> <br /> On motion of Mr. Johnson, the following ordinance was approved on first reading, without <br />dissenting vote: <br /> <br />"ZONING AMENDMENT ORDINANCE Z 67-5" <br /> <br />The following reports from the City Manager were read: <br /> <br /> 67-186 - "I submit the attached resolution and recommend its adoption. <br /> This appoints viewers for the closing of a portion of Nottoway Avenue lying between <br />the northern right-of-way line of King Street and the southern right-of-way line of Atlantic Coast Line <br />Railroad. <br /> This closing has been approved by the Planning Commission." <br /> <br />On motion of Mr. Eastes, the following resolution was adopted, without dissenting vote: <br /> <br /> "~{EREAS, W. C. O~borne has made application to vacate and close that portion of Nottoway <br />Avenue lying between the northern right of way line of King Street and the southern right of way <br />line of the Atlantic Coast Line Railroad, and it appearing that notice of the application and request <br />for the appointment of viewers was duly posted on June 1S, 1967, on the bulletin board of the Court <br />of Hustings for the city of Portsmouth, on the bulletin board of the Circuit Court of the City of <br />Portsmouth, and on the bulletin board of the Municipal Court of the City of Portsmouth. <br /> NOW, THEREFORE, BE IT RESOLVHD by the Council of the City of Portsmouth, Virginia, that L. A. Clark, <br />Frank Bilisoly, John E. Scott, Holt W. Butt, Sr., and Jimmy McGehee be appointed viewers to view said <br />street and report to th~s council in writing whether in their opinion any, and if any, what inconvenience <br />would r'esult from vacating and closing the aforementioned partof Nottoway Avenue." <br /> <br /> 67-187 - "I at,mit the attached resolution and recommend its adopti~ <br /> This appoints viewers for the closing of a portion of Griffin Street east of its <br />intersection with Dinwiddie Street extending to the rightrof-way of the Seab~ard Airline Railroad <br />Company. <br /> This closing has been approved by the Planning Commission." <br /> <br />Motion of Mr. Eastes to adopt the resolution. <br /> <br /> Motion of Mr. Knight to amend the resolution by striking the names Jefferson Brown and Robert <br />Wentz from the viewers, was adopted. <br /> <br />Vote being taken, the amended motion was adopted, without dissenting vote, as follows: <br /> <br /> "WMEP~AS~ Washington Court Corporation, by C. Roy Kelly, President, has made application to <br />vacate and close that portion of Griffin Street which lies east of the intersection of Griffin <br />Street with Dinwiddie Street, Portsmouth, Virginia, ~ich extends to the right of way of the Seaboard <br />Air Line Railroad Company, and it appearing that notice of the application of viewers was duly <br />posted on May I8, 1967, on the bulletin board of the Circuit Court of the City of Portsmouth, Virginia, <br />and at two public places in the City of Portsmouth, Virginia, namely on the Virginia Electric and <br />Power Company pole number 1 54 (second numeral missing) at the southwestern corner of the intersection <br />of Griffin Street and Dinwi~die Street, and on the Virginia Electric and Power Company pole number 7511 at <br />~he northeast intersection of the railroad track of Seaboard Air Line Railroad Company and Dinwiddie <br />Street at the southwestern corner of the subject property. <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, ~hat E. Gayle Ross, <br />Richard Bartlett, Milliard C. Norman be ~pointed viewers to view said street and report to this <br />council in writing whether in their opinion any, andif any, what inconvenience would result from!vacating <br />and closing the aforementioned part of Griffin Street." <br /> <br /> 67-188 - "I submit the attached resolution and recommend its adoptidn. <br /> This authorizes condemnation proceedings for the acquisition of property necessary for the <br />widening of the London-Glasgow Stregt Expressway. <br />This resolution is necessary as the City has not been able to locate certain property <br />owners and the status of the title of the property is uncertain. We have not been able to agree upon <br />the price to be paid to others. <br /> This resolution is necessary in order that we can proceed to take title of the land, as <br /> construction cannot proceed until all right-of-way is obtained and so certified to the State Highway <br /> Department." <br /> <br />On motion of Mr. Leary, the following resolution was adopted, withoUt dissenting vote: <br /> <br /> <br />
