<br /> WHBREAS, one of the obligations of the City of Portsmouth with respect to said project
<br />is the provision of the land necessary for the construction; and
<br /> WHEREAS, the City of Portsmouth has found it Ko be necessary to acquire the interest
<br />hereinafter specified in and to the hereinafter described parcels of lal~d s~tuRt~;inftke[3~ity
<br />of, Portsmbuth, Virginia, for the purpose Of constructing, widening and improviffgi~th~aforesaid
<br />State~High~y Route 58; and
<br /> WHEREAS, the City of Portsmouth has not been able to purchase the property described
<br />herein, necessary to the project, because the owners thereof and the City have not been
<br />able to agree upon the price to be paid therefor, or the City has not been able to locate
<br />certain of the owners of because of the status of the title of certain parcels of the property;
<br />and
<br /> Wq~BREAS, advancement of the work and use of said State Highway Route 58 will be delayed
<br />unreasonably is the said property isa,not made available as soon as possible.
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br /> Section 1, The City Attorney is directed to institute eminent domain proceedings, employing
<br />s~ecial counsel for that purpose if he deems it advisable against the property hereinafter
<br />d~scribed ~ocated a$ong State Highway Route 58, for the purpose of acquiring fee simple title
<br />there~n, in accordance with and pursuant to Section 25(f) of the Charter of the City of
<br />Portsmouth (Chapter 229 of the Acts of Assembly of 1966), and to deposit to the credit of the
<br />court as provided by law the sum hereinafter specified to compensate the respective owners of
<br />the various parcels of land, as shown on those certain plans entitled Project 0058-124-102,
<br />R/W 201 and 202 dated February 14, 1966, sheet 21, a copy of which i~ filed with the Department
<br />of Public Works of the City of Portsmouth, Virginia:

<br />air.polution district. This project has, been sponsored by the Hampton Reads Area Wide Cooperation

<br />political sub-divisions adopt a similar resolution andsubmit a representative for the local air
<br />polution control district."

<br />AIR POLLUTION CONTROL DISTRICT IN THE HA~PTON ROADS AREA."

<br /> "WHEREAS, the several political subdivisions of the Hampton Roads area share .pMoblems
<br />of air pollution; and
<br /> ?~EREAS, Section 10-17.19 of the Code of Virginia, 19S0, as amended, provides for the establish
<br />ment of local air pollution control districts comprising two or more cities or counties, or
<br />any combination or parts thereof, upon request of the respective governing bodies.
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City Of Portsmouth, Virginia,
<br />that the State Air Pollution Control Board is hereby requested to establish a Local Air
<br />Pollution Control District to include the Cities of Chesapeake, I~pton, Newport News,
<br />Norfolk, Portsmouth, Suffolk, and Virginia Beach and the Counties of Nansemond and York,"

<br /> 67-247 - "As requested by the City Council, I submit~herewlth~ my investigation of the
<br />request that retail merchants be permitted to pay their busines~ license on a quarterly basis.
<br />Recently this same request was asked to the City Council of Norf~k~ and the City Manager of
<br />Norfolk submitted a questionnaire to the eleven largest cities in the state. This questionnaire
<br />reveals~the following information:
<br /> Five of the eleven cities permit annual payment only, Three of the eleven
<br />permit semi-annual payments. Three of the eleven permit quarterly payments. Four of the
<br />six cities permitting either quarterly or semi-annual payments estir~%te some loss because
<br />of the payments schedules. Two of the six cities indicate they do not believe they suffer
<br />any loss from the, split payment schedule. Three of the fi~e, cities that require annual
<br />payment estimate that a ~lit schedule payment will result in loss. One city did not comment
<br />on this~ques~ion and one city did not believe there would be any loss in revenue. The rate
<br />of majority opinion of both cities that permit a split payment, and those that do not, is
<br />lhat there would be a loss of revenue with one instance of a-city that does not permit split
<br />payment estimating 10 to 12 per cent and the other city 10 to 20 per cent. Those cities,
<br />commenting on administrative and collection costs, all agreed that there is additional
<br />work involved, ~hich is obvious.
<br /> The cities that have a semi-annual or quarterly payments, require that the merchant
<br />pay half of the license by January S1 or one quarter by January S1, if on the quarterly payment
<br />basis, The thing that has been overlooked, by the merchants, is the fact that the advantage in
<br />either the quarterly or semi-annual payment is not nearly so great as it may appear, when you
<br />consider they would have already paid one half of their yearly license by May $1, under the quarterl
<br />plan, whet? under our p?~sent system they are not required to p~ly the license until May 51, before
<br />any penalty is applied. The merchants have four months to use the entire amount of money
<br />involved in the businessslicense, that would not be available to them under the other schedules
<br />of payment established by those cities that do permit either quarterly or semi-annual payments,
<br /> According to a report, received from the Co~missioner of Revenue's office,
<br />during the license year of May 1~ 1966~ thru April 50, 1967, a total of 1~087 business ~icenses
<br />were issued. Of the retail grocery license, 29 were issued to grocery businesses whose license
<br />amounted to $100,00 or less, A Total of 69 licenses were issued to groce~z businesses whose
