<br />Motion of Mr. Barnes to c~cur in the recommendation of the City Manager was adopted, without
<br />dissenting vote.
<br />
<br /> 67-286 - "I submit the attached resolution and recommend its ~dontion.
<br /> This resolution instructs the special Rnnexation attorneys to endorse and enter the
<br />annexation order to the annexation court. This order is identical in substance to the decree of the
<br />except there will be no compensation for the West Norfolk Bridge.
<br /> The resolution also provides that annexation will be effective at midnight, December 51, 1967.
<br />It further provides that the resolution will not be valid unless the City Council of the City of
<br />Chesapeake has adopted an appropriate resolution causing the order to be entered."

<br />On motion of Mr. Johnson, the following resolution was adonted, without dissenting vote:
<br />
<br /> "WHEREAS, by ordinance adopted December 9, 1961, the City Council of the City of Portsmouth petitioned
<br />the Circuit Court of Norfolk County for annexation of those areas of Norfolk County therein described; and
<br /> WHEP~AS, the City of Chesapeake became the successor to Norfolk County, ~nd said annexation
<br />petition duly came on to be tried; and
<br /> WHEREAS, by a written opinion dated October 14, 1966, the Special Annexation Court announced its
<br />decision on the question of necessity and expediency of annexation, and described an area of
<br />approximately 10 square miles to be annexed; and
<br />WHEP. HAS, after additional trial of the financial issues of the cause, the Special Annexation Court
<br />rendered its written opinion dated April 25, 1967, wherein the financial adjustments were prescribed; and
<br /> WHEREAS, the City Council of the City of Portsmouth directed its Special Annexation Attorneys to negotiat
<br />with the attorneys for the City of Chesapeake to the end that the effective date of annexation would be
<br />December S1, 196u, with the City of Chesapeake foregoing payment for the West Norfolk Bridge in the
<br />sum of $500,000.00, and all parties agreeing not to appeal the matter, which has been accomplished; and
<br /> WHEREAS, the City Council of the City of Portsmouth, after a full and detailed review of the
<br />current annexation proceedings, including a proposed final annexation order therein, ~md acting thereon mhd
<br />on the advice of its attorneys and consultants, is of the opinion that the best interests of the City
<br />of Portsmouth will be served by now concluding said litigation: and
<br /> WHEREAS, the City Councils of the City of Portsmouth and the City of Chesapeake have instructed
<br />their respective attorneys to enter into a stipulation carrying out the aforesaid arrangement
<br />for final disposition of this case.
<br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Portsmouth that the Special
<br />Annexation Attorneys representing the City of Portsmouth in the annexation proceedings now
<br />pending against the City of Chesapeake are instructed to endorse and cause to be entered by the
<br />Special Annexation Court an annexation order in form and substance identical to the draft of such
<br />order filed with the minutes of this meeting; said annexation order to carry out the aforesaid opinions,
<br />except tha~ there shall be no compensation for the West Norfolk Bridge, and which order shall provide
<br />that December 51, 1967, at midnight, shall be the effective date of annexation, and that none of
<br />the parties shall note any exception or objection to the entry of said annexation order, nor shall
<br />any party attempt to appeal said order.
<br /> The effect of this resolu~ion~shall be to accept annexation of the territory described in said
<br />order unon the terms and conditions therein stated.
<br /> This resolution shall be of no force or effect unless and until the City Council of the City
<br />of Chesapeake shall haEe adopted an appropriate resolution instructing its annexation attorneys to
<br />endorse and cause to be entered by the Special Annexation Court an annexation order in form and
<br />substance identical t6 that filed with the minutes of this meeting."

<br />HAZARDS ON VESSELS AND MAKING IT UNLAWFUL TO VIOLATE SUCH REGULATIONS"
