November 14, 1967 <br /> <br /> 67-323 - "At the last meeting of the City Council, a petition concerning a drainage problem in <br />the rear of the properties on Harris Road was referred to me. This matter Was investigated <br />by the Public Works Department and they advised me that Mr. FlOyd W. Simpson, 6 Reid Street owns the <br />property, on the rear of the properties on Harris Road~ This land is filled to a high elevation <br />in some instances, at the rear of the lots owned by the petitioners. This condition is all on <br />privately owned property and therefore is a civil matter between the property owners. <br /> A solution to the problem would be to install a storm drain along the rear lines <br />of these properties with catch basin inlets needed from Nicholson Street to Reid Street. There is <br />no existing easement for this, and one w0u~d have to be acquired from the owners or they would have <br />to dedicate a 15 foot strip for this purpose. The distance between these two streets is 1100 feet <br />more or less and th~ cost of the installation would be approximately $8,700.00. <br /> The policy of the City, in a situation such as this, is for the property owners to <br />dedicate a 15 foot easement and they purchase the pipe and the City do the installation. If <br />the property owners can reach an agreement on this matter, the City can do the installation of <br />the pipe." <br /> <br /> Motion of Mr. Johnson to receive as information and that the City Manager notify the parties <br />involved, was adopted, without dissenting vote. <br /> <br /> 67-S~4 - "I have investigated further the feasibility of disposing of the Westhaven Recreation <br />Center on County Street or'repairing the building. <br /> S~l~ile there are no organized activities, by the Recreation Department, in this <br />building, it is being used by various grotrps in the City. <br /> I find, that if this building were to be eliminated and these activities transfered <br />to the RedreationFaci~i~ies~an~tah~Streeti~t~uld?~q~e~he ~ur~ailment!of~so~re~e~ip~ <br />activities at this location. <br /> I therefore, do not recommend we dispose of this building on County Street. An. <br />estimate has been made of the cost of repairs, both interior and exterior; this amounts to <br />approximately $2,$75.00. I am authorizing the Buildings and Grounds Department to proceed with <br />the necessary exterior repairs to this buiI~ing." <br /> <br /> Motion of Mr. Eastes to receive as information and that the Westhaven Recreation Center representatives <br />be notified of the action taken, was adopted, without dissenting vote. <br /> <br /> 67-525 - "I submit the attached resolution and recommend its adoption. <br /> This authorizes Condemnation proceedings on 10 pieces:-of property involved in the <br />London Glasgow Street Expressway. On.~some of these properties, we have not been able to locate the <br />owners and on the others we haVe,not been able to agree on a price." <br /> <br /> On motion of Mr. King, the following resolution was adopted, without dissenting vote: <br /> <br /> 'q~EREAS, ~n cooperation with the Federal and State governments, State Highway Route 58 is <br />being constructed, widened and ~mproved from the intersection of Airline Turnpike and High Street <br />to the intersection of London and Effingham Streets in the City of Portsmouth, Virginia; and <br /> I~EREAS, onecof the obligations of the City of Portsmouth with respect to said projedt is the <br />provision of the land necessary for the construction; and <br /> $%~EREAS, the City o~ Portsmouth has found it to be necessary to acouire the interest hereinafter <br />snecified in and to the hereinafter described parcels of land situate in the City of Portsmouth, <br />Virginia, for the purpose of constructing, widening and improving the aforesaid State Highway Route <br />58; and <br /> ~.~HREAS, the City of Portsmouth has not been able to purchase the3 property described~herein, <br />necessary to the project, because the owners thereof and the City have not been able to'agree <br />unon the price to be paid therefor, or the City has not been able to locate certain of the owners or <br />because of the status of the titte of certain parcels of the property; and <br /> WH£REAS, advancement of the work and use of said State Highway Route 58 will be delayed <br />unreasonably if the said property is not made available as soon as oossible. <br /> NOW, THEREPORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> Section 1. The City Attorney is directed to institute eminent domain proceedings, employing <br />soecial counsel for that puroose if he deems it advisable against the property hereinafter described <br />located along State Highway Route 58, for the purpose of acquiring fee simnle title therein, in <br />accordance with and pursuant to Section 25[~) of the C~a~ter' ofcthe City of Portsmouth (Chanter 229 of the <br />Acts of Assembly of 1966), and to deoosit to the credit of the court as nrovided by law the' sum <br />hereinafter specified to compensate the respective owners of the various oarcels of land, as <br />shown on those certain olans entitled Project 0058-124-102, R/W 201 and 2~2 dated ~ebruary 14, 1966, <br />sheets 10, 15, 16, 17, 18, 21, and 22, a copy of which is filed with the Deoartment of Public Works of <br />the City of Portsmouth, Virginia: <br /> <br />Parcel Name Amount <br /> <br />074 Mabel L.
