January 9, 1968 <br /> <br /> ~fltEREAS, the City of Portsmouth has found it to be necessary to acquire the interest hereinafter <br />~pecified in and to the hereinafter described parcels of landsituate in the City of Portsmouth, <br />Virginia, for the purpose of constructing, widening and improving the aforesaid State Highway <br />RouteS8; and <br /> I~EREAS, the City of Portsmouth has not been able to purchase the property described herein, <br />necessary to the project, because the owners thereof and the City have net been able to agree upon <br />the price to be paid therefor, or the City has not been able to locate certain of the owners <br />or because of the status of the title of certai~ parcels of the property; and <br /> WHEREAS, advancement of the work and use of said State Highway Route 58 will be delayed <br />unreasonably if the said property is not made available as soon as possible. <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> Section 1. The City Attorney is directed to institute eminent domain proceedings, employing <br />special counsel for that purpose if he deems it advisable, against the property hereinafter <br />described located along State Highway Route S8, for the purpose of acquiring fee simple title <br />therein, in accordance with and pursuant to Section 23(?) of the Charter of the City of <br />Portsmouth (Chapter 229 of the Acts of Assembly of 1966), and to dep0ait to the credit of the court <br />as provided by law the sum hereinafter specified to compensate the respective owners of the <br />various parcels of land, as shown on those certain plans entitled Project 0058-124-102, R/~I 201 <br />and 202 dated February 14, 1966, sheet 18, a copy of which iff filed with the Department <br />of Public Works of the City of Portsmouth, Virginia: <br /> <br />PA~RSEL N/~iE ' ~MoUNT <br /> <br />191 Mark L. Andrews, Jr., et ux, et al $t,300.00 <br /> <br /> Section 2. The City Attorney is authorized taproceed against each individual parcel and the respect- <br />ive owners thereof or against such combinations ~ parcels and the respective owners thereof as he <br />shall deem advisable." <br /> <br />-UNFINISHED BUSINESS- <br /> <br />67-578 - The followimg ordinance approved on first reading at lamt meeting, was taken up and read: <br /> <br />"AN ORDINANCE TO APPROPRIATE $48,465.00 FROM THE GENERAL CAPITAL IMPROVF~MENT FUND FOR THE PURChaSE <br />OF PROPERTY IN THE WEAVBR URBAN RENEWAL PROJECT VA-40 FOR TIlE RIDDICK WEAVER SCHOOL MITE" <br /> <br />On motion of Mr. Johnson, the ordinance was adopted, and by the following vote: <br /> Ayes: Smith, Barnes, Eastes, Johnson, King, Knight <br /> Nays: None <br /> <br /> 67-579 - The following ordinance, approved on first reading at last meeting, was taken up and <br />read: <br /> <br />"AN ORDINANCE TO APPROPRIATE $31,70S.70 FROM THE GENERAL CAPITAL IMPROVEMENT FUND <br />FOR A TEMPORARY LOAN TO THE PORTSMOUTH PORT AWD INDUSTRIAL CObg~ISSION,' <br /> <br />On motion of Mr. Eastes, the ordinance was adopted, and by the followinggvote: <br /> Ayes: Smith, Barnes, Eastes, Johnson, King, Knight <br /> Nays: None <br /> <br /> 67-565 - The following ordinance, approved on first reading at last meeting, was taken up and <br />read: <br /> <br />"AN ORDINANCE TO CLOSE A PORTION OF HANOVER AVENUE" <br /> <br />On motion of Mr. King, the ordinance was adopted, and by the following vote: <br /> Ayes: Smith, Barnes, Eastes, .Johnson, King, Knight <br /> Nays: None <br /> <br />-NEW BUSINESS- <br /> <br /> 68-11 - The following letter from Robert ~entz, Jr., was read, and on motion of Mr. Johnson, referred <br />to a conference of the Council: <br /> <br /> "The Churchland Area Citizens Advisory Planning Committee is now ready with a preliminary <br />graphic repor~ ~n the Zoning and Land Use study for the Western Branch Area to be annexed on January <br />1~ 1968. <br /> At the pleasure of the City Council, we would like to make a presentation of this report at the <br />Council's first meeting in January. <br /> We would appreciate it if you will, on behalf of the Committee, make whatever arrangements are <br />necessary." <br /> <br /> 67-584 - On motion of Mr. Eastes, the r~les were suspended to hear the following, who spoke <br />in regard to the closing of Mulber~ Street: <br /> Father Joseph Cilinski <br /> Marlino, of Brennan Funeral Home <br /> Ben Foster, Foster Funeral Home <br /> J.
