<br />On motion of Mr. King, the following resolution was adopted, without dissenting vote:
<br />
<br />"TO IMPOSE A LOCAL CITY USE TAX IN THE CITYO0F POR~4OU~{, VIRGINIA, PURSUANT TO 58-441.49:'1
<br />OF THE CODE OF VIRGINIA [CHAPTER 191, ACTS OF ASSE~MBLY, 1968), AT THE RATE OF ONE PER CENT
<br />TO PROVIDE REVENUE FOR THE GENERAL FUND OF ~]E CITY
<br />
<br /> I',~EREAS, the City of Portsmouth has heretofore imposed the local sales tax authorized by 58-441.49
<br />of the Code of Virginia; and
<br />
<br /> WHEREAS, 58-441.49:1 of the Code of Virginia (Chapter 191, Acts of Assembly, 1968), provides that
<br />a city which has previously imposed the local sales tax authorized by 58-441.49 of the Code of Virginia may
<br />impose a local use tax by the adoption of a resolution by the council of the city by a majority of all the
<br />members thereof, by a recorded yea and nay vote, stating its purpose and referring to 58-441.49:1 of the
<br />Code of Virginia; and
<br />
<br /> ~{EREAS, the said 58-141.49:1 further provides that the local use tax shall become effective on the
<br />first day Of a-month at least 60 days after the adoption of the resolution, but not earlier than July 1,
<br />
<br /> f~HEREAS, the said 58-441.49:1 also provides that the resolution authorized thereby may be adonted
<br />in the m~nner stated notwithstanding any other provision of law, including any charter provision;
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, as follows:
<br />
<br /> I. Pursuant to 58-441.49:1 of the Code of Virginia (Chapter 191, Acts of Assembly, 1968), there
<br />is hereby imposed in the City of Portsmouth a local city use tax at the rate of one per cent to provide
<br />revenue for the general fund of the city. The said city use tax shall be added to the rate of the
<br />State use tax imposed by Chapter 8.1, Title 58, of the Code of Virginia, and shall be subject to all the
<br />provisions of that chapter, and all ~Lmendments thereof, and the rules and regulations DubS;shed with
<br />respect thereto. Therefore, the purpose of this resolution is to impose thelocal use tax authorized by
<br />58-441.49:1 of the Code of Virginia.
<br />
<br /> 2. The effective date of the use tax imposed by this resolution ,hal] be the first day of July, 1968,
<br />and the same shall be in force on and after that date.
<br />
<br /> 5. The Clerk of the Council of the City of Portsmouth shall forthwith forward to the State Tax Com-
<br />missioner of the Commonwealth of Virginia a certified copy of this resolution so that it will be received
<br />within five days after its adoption."
<br />
<br />68-150 - "I submit the attached resolution and recommend its adoption.

<br /> This authorizes the submission of the Model City application for the City of Portsmouth. This must
<br />be submitted to the Department of Urban Development by April 15, 1968.
<br />
<br /> Again, our theme for this aoplication is'~ Demonstration o~ Military Imoacted~ RenewalArea Leadership".
<br />It deoicts the major problems facing the Portsmouth Model City Area, identification of the basic causes of
<br />those problems and general indication as to the kinds of research and planning studies which are required
<br />to eliminate these causes, One of the basic components of this application is an interdeoartmental agree-
<br />ment among the secretaries of Defense, Transportation and Housing and Urban Develonment which would a~t$orize
<br />participation by the military services in a national Model City Demonstration Program. To date, this
<br />agreement has not been forthcoming; however, we are continuing to press for the agreement as we feel it is
<br />vital to the success of our application."

<br />On motion of Mr. Barnes, the following resolution was adopted, without dissenting vote:
<br />
<br />"RESOLUTION OF LOCAL GOVERNING BODY APPROVING REQUEST FOR FINANCIAL ASSISTANCE TO PLAN ~ND DEVELOP
<br />A COMPREHENSIVE CITY DEMONSTRATION PROGRAm!
<br />
<br /> W_~REAS, the City of Portsmouth desires to undertake a comprehensive city demonstration program to
<br />rebuild or revitalize large slum and blighted areas and generall~ improve living conditions for the people
<br />who live in such areas; and
<br />
<br /> WHEREAS, the Secretary. of Housing and Urban Development (hereafter referred to as the "Secretary")
<br />is authorized pursuant to Title I of the Demonstration Cities and Metropolitan Development Act of 1966 to
<br />make grants to, and contract with, City Demonstration Agencies to pay up to 80 percent of the costs of
<br />planning and developing such comprehensive city demonstration programs:
<br />
<br />NOW, TNEREORE, be it resolved by the Council of the City of Portsmouth as follows:
<br />
<br /> Section 1. Approval is hereby granted (1) for the submission by the City of Portsmouth of a request
<br />for financial assistancefor the planning and development of a comprehensive city demonstration program;
<br />(2) for the provision of any information or documentation concerning the preparation and content of such
<br />program as may be required by the Secretary; and (5) for the representation by A. P. Johnson, Jr., City
<br />Manager, or his lawful successor, ~s the authorized representative empowered to act on behalf of the City
<br />of Portsmouth in connection with all matters pertaining to ~e request ~6r financial assistance.
<br />
<br /> Section 2. The City of Portsmouth hereby agrees to comply with the regulations o.f the Secretary
<br />effectuating Title VI of the Civil Rights Act of 1964, which ~rovide that no ~erson shall, on the ground of
<br />race, color or national origin~ be excluded from ~articiDatio~ in, be denied %he benefits of, or be subjected
<br />to discrimination in the undertaking of any of th~ projects or activities assisted under Title I of the
<br />Demonstration Cities and Metropolitan Development Act. of 1966. :
