<br /> 68-126 - "I submit the attached ordinance and recommend it be placed on first reading. This changes
<br />the lettered streets in the Churchland area to names recommended by a resident of the area. This also
<br />changes Lilac Drive, east of Dogwood Drive, to Michael Lane. This is requested as it creates a problem of
<br />properly renumbering the houses. There are no residents on this portion of Lilac Drive, and will only affec~
<br />the Churchland Elementary School."

<br /> On motion of Mr. Knight, the following ordinance was approved on first reading, without dissenting
<br />vote:

<br /> 68-127 - "I submit the attached ordinance and recon~end it be placed on first reading. This closes a
<br />portion of Columbia Street from its juncture with Frederick Boulevard and Airline Boulegard, eastward to
<br />and extMnsion of the lot lying between lots 8 and 10 in block 156 for a dista~ce of approximately 128 feet.
<br />This has been approved by the Planning ComMission and a report of the viewers is attached her~tp."

<br /> On motion of Mr. King, the following ordinance was approved on first reading, without dissenting
<br />vote:

<br /> 68-128 - "I submit the attached resolution and recommend its adoption. This authorizes condemnation
<br />proceedings for property needed for the London-Glasgow Street Expressway. This ae~ion is necessary due
<br />to title deficiencies in the property."

<br />On motion of Mr. Leafy, the following resolution was adopted, without dissenting 9ute:

<br />"A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY OF PORTSMOLrFH UNDER
<br />EMINEN~ DOMAIN PROCEEDINGS PURSUANT TO CHAPTER 229 OF THE ACTS OF ASSr{ELY OF 1966, SAID PROPERTY
<br />BEING NECESSARY FOR THE CONSTRUCTION, WIDENING AND IMPROVEMENT OF STATE HIGHWAY ROUTE S8 FROM THE
<br />INTERSECTION OF AIRLINE BOULEVARD ~qD HIGH STREET TO THE INTERSECTION OF LONDON AND EFFINGH.~I
<br />STREETS.~'

<br /> ~HEREAS, in cooperation with the Federal and State governments, State Highway Route 58 is being
<br />constructed, widened and improved from the intersection of Airline Boulevard and-High Street to the
<br />intersection of London and Effin~ham Streets in the City of Portsmouth, Virginia; and
<br />
<br /> ~tEREAS, one of the obligations of the City of Portsmouth with respect to said project is the ~rovision
<br />of the land necessary for the construction; ~nd
<br />
<br /> I*~{EREAS, the City of Pom~smouth has found it to be necessary, to acquire the interest hereinafter
<br /> snecified in and to the hereinafter described parcels of land situate in the City of Portsmouth, Virginia,

<br />
<br /> ZMEREAS, the City of Portsmouth has not been able to purchase the property described herein, necessary
<br />to the project, because the owners thereof and the City have not been able to agree uoon the orice to be
<br />pa~d therefor, or the City has not been able to locate certain of. the owners or because of the status of
<br />the title of certain parcels of the property; and
<br />
<br /> P~MEREAS, advancement of the work and use of said State Highway Route 58 will be delayed unreasonably
<br />if the said property is not made available as soon as possible.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth,Virginia:
<br />
<br /> Section 1. The City Attorney is directed to institute eminent domain proceedings, employing special
<br />counsel for that purpose if he deems it advisable, against the property hereinafter described located
<br />along State Highway Route 58, for the purpose of acquiring fee simple title therein, together with a temporary
<br />construction easement in accordance with a~d oursuant to Section 25 (P) of the Charter of the City of
<br />Portsmouth {Chapter 229 of the Acts of Assembly of 1966), and to deposit to the credit of the court as provided
<br />by ~h~ %~e sum hereinafter specified to compensate the respective owners of the various parcels of land~ as
<br />shown on those certain nlans entitled Project 0058-124-102, R/W 201 and 202 dated February 14, 1966, sheet 6,
<br />a copy of which is filed with the Department of Public P~orks of the City of Portsmouth, Virginia:

<br /> Section 2. The City Attorney is authorized to oroceed against each individual oarcel and the respective
<br />owners thereof or against such combinations of narcels and the resnective o~ners thereof as he shall ~ee~
<br />advisable."
<br />
<br /> 68-129 - "I submit the attached resolution and recommend its adoption. This imposes a 1% use tax in
<br />conjunction with the local 1% sales tax.
<br />
<br /> Th~ General Assembly of Virginia in the 1968 session, passed legislation to permit cities and counties
<br />to levy the use tax. This will be collected in the sane manner as the sales tax is now collected by the
<br />State. This will provide additional revenue and also orevent out-of-state dealers from having a comnetitive
<br />advantage over Virginia dealers. For the most part, the local use tax will be collected by out-of-state
<br />dealers from their Virginia=customers for payment to the State and the~State will distribute same to the
<br />City.
<br />
<br /> It is necessary that this resolution be adooted 60 days prior to it being effective. In no case can it
<br />be effective before Jul}, 1, 1968."
