May 14, 1968 <br /> <br /> E. S. Everhart, President, Associated Naval Architects, spoke, requesting the City to communicate with <br />the Coast Guard and express its opposition to the closing of the West Norfolk Bridge for any ueriod of time, <br />as this would hove serious effects on his and other business concerns in that area. <br /> J. L. Zabo~of 217 Duke Drive, spoke in favor of the closing of the bridge as requested by Merrifield <br />and Edgefield Civic Clubs. <br /> C. C. Shepherd, Shepherd's Marina, West Norfolk, spoke in opposition to the closing. <br /> Bill Bradley, representing Merrlflei and Edgefield Clubs, stated he woul confer with the people of his <br />community. <br /> Motion of Mr. Knight that the Coast Guard be advised that the City Council is onnosed to an), closing of <br /> the West Morfolk draw b¥~ was adopted, without dissenting vote. <br /> 68-1S7 - "I submit the attached ag=eement between the Virginia Electric and Power Company and the City <br /> of Portsmouth and recommend the proDer City officials be authorized to sign. <br /> This nrovides for a power line easement on the Churchland Academy nlay~round in order that Dower ~an be <br /> furnished to light the baseball field." <br /> Motion of Mr. Barnes to concur in the recommendation of the City Manager was adopted, without dissenting <br /> vote. <br /> 68-1S8 - "I submit the attached ordinance and recommend it be placed on first reading. This establishe~ <br /> the procedure for fimancing the construction of sidewalks between the City and propertyowners. <br /> This nrovictes that upon petition by three-fourths of the land owners involved, the City can proceed <br /> with the installation of sidewalks and assess the Uroperty owner for 50% of the cost. It further ~rovides <br /> that notice shall be given to the abutting land owners, notifying them when and where they may appear before <br /> the City Council to be heard in favor of or against such improvements. <br /> The ordinance further provides that a person, firm, or corporation against whom the assessment has been <br /> made, may pay such assessment in equal installments over a neriod not exceeding five years, together with <br /> interest at the rate of 6% 9er annum on the unpaid balance. The installments shall become due a~zthe same <br /> time that real estate taxes become due and payable, and the amount of each installment including principal <br /> and interest shall be sho~m on the tax ticket mailed to such nerson, firm or corooration." <br /> On motion of Mr. Barnes, the following ordinance was approved on first reading, without dissenting <br /> VOte. <br /> <br /> "AN ORDINANCE TO ~MEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1961, BY ADDING TO <br /> CHAPTER 51THEREOP A NEW ARTICLE CONSISTING OF TEN SECTIONS PROVIDING POR THE IMPOSITION <br /> OP ASSESSMENTS UPON ABUTTING LANDOWNERS FOR LOCAL IMPROVEMENTS." <br /> <br /> ~8-~ - "I submit the attached resolution and recommend its adoption. <br /> In order for the Highway Department to proceed with the advertisement for the construction of the <br />Effingham Street Extension, it is necessary that this resolution be adopted. This certifies that all <br />arrangements have been made or will be made fd~ the relocation and/or adjustment of all utilities involved <br />in the construction of this new highway. It further provider that the City of Portsmouth will be responsible <br />for any justifiable claims for d~lays or interference caused by said utilities." <br /> On motion of Mr. King, the following resolution was adopted, without dissenting vote: <br /> "A RESOLUTION ASSb~ING RESPONSIBILITY FOR UTILITY RELOCATION IN CONNECTION WITH THE EPFINGHA~4 <br /> STREET PROJECT." <br /> <br /> WHEREAS, the Highway Department proposes to construct or otherwise improve sections of ra~¢yfCrom <br />the Intersection of George W~shington Highway and Peach Street to Portsmouth Boulevard including Access Raad <br />to Norfolk Naval Shipyard and Ramps, designat~ as Projects 0141-124-101, CS01, and 0141-124-102, CS01, <br />respectively, and <br /> <br /> f~HEREAS, the City Council is responsible for making arrangments for the adjustment and/04 relocation <br />of certain utilities and for the installation of any new utility facilities; <br /> <br /> ~g THEREFORE, BE IT RESOLVED, that the City Council of Portsmouth hereby certifies that all arrange- <br />ments have been made or will be made for the relocation and/or adjustment of said utility facilities, and for <br />the installation of any new facilities. In the event of any justifiable claims from the road contractor <br />for delays or interference caused by said utilities, the City of Portsmouth hereby agrees to be responsible <br />for said claims, provided the City is advised in writing by the Highway Department at t'h~ time of delay that <br />the Road Contractor intends to file a claim. The Highway Commissioner shall decide all eaestions, diffi- <br />culties and disnutes of what ever nature that may arise because of the delay. <br /> <br />Said utilities are identified as follows: <br /> <br /> U~ility O~mer <br /> <br /> City of Po=tsmouth <br /> Portsmouth Gas Company <br />The Chesapeake and Potomac Tel. <br /> Company <br /> U.
