May 14, 1968 <br /> <br /> ICHEREAS, Sanford L. Lefcoe, .Jules J. Siegel, and Arthur Siegel have made application to vacate and <br />~lose that hereinafter described portions of certain streets and alleys located in the. Churchland~ area <br />and it appearing that notice of the application and request for the appointment of viewers was duly <br />posted on Anril 22, 1968, on the bulletin board of the Court of Hustings for the City of Portsmouth, on the <br />bulletin board of the Circuit Court of the City of Portsmouth, and on the bulletin board of the Municipal <br />Court of the City of Portsmouth. <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that Zalmon !. <br />Blackmon, R. A. Craig, Jr.,'Wilson Rowe, Millard Norman, and Robert W. Wentz, .Ir. be appointed viewers to <br />view the hereinafter described portions of certain streets and alleys and report to this council in writing <br />whether in their opinion any, and if any~ what inconvenience would result From vacating and closing the <br />following portions of the specified streets and alleys: <br /> 1. The t)latted, but unopened alleyway located in Block 33 of the Plat of Churchland Land Company, <br />which alley s~parates the unplatted land as ~ho%~ua in Block 33 from lots 10 through 17, incl(lsive. <br /> 2. The nlatted, but unopened ~ortion of B Street as shown on the Plat of Churchland Land Company which <br /> lies between ~lots t0 through ~7, inclusive, Block 33 of the Churchland Land Cempany and lots 18 through 26, <br /> inclusive, Block 32 of the Churctand Land Company. <br /> 3. The platted, but unopened alleyway located in Block 52 of the Plat of Church!and Land Company, and <br /> which separates lots 18 through 26, inclusive, from lots 10 through 17, inclusive, %n Block 32 of the <br /> Churchland Land Company." <br /> <br /> 68-152 - "I submit the attached resolution and recommend its adoption. This authorizes condemnation <br /> ~roceedings for the London-Glasgow Street Expressway. This involves two narcels of land ~or which the City <br /> ~nd the owners have not been able to agree on nrice." <br /> On motion of Mr. Eastes, ]lhe following resolution was adopted, without dissentin~ ~o~e: <br /> "A RESOLUTION TO PROVIDE FOR THE ACOUISITION OF CERTAIN PROPERTY BY THE CITY OF PORTSMOUTH UNDER <br /> EMINEHT DOMAIN PROCEEDINGS PURSUANT TO CHAPTER 229 OF THE ACTS OF ASSEMBLY OF 1966, SAID PROPERTY_ <br /> BEING NECESSARY FOR THE CONSTRUCTION, WIDENING AND IMPROVF34ENT OF STATE HIGHI~AY ROUTE 58 FROM THE <br /> INTERSECTION OF AIRLINE BOULEVARD AND HIGH STREET TO THE INTERSECTION OF LONDON AND EFFINGH~M STREETS. <br /> ~HEREAS, in cooperation with the Federal and State governments, State Highway Route 58 is being <br /> constructed, widened and improved from the intersection of Airline Boulevard and High Street to the inter~ <br /> section of London and Effingham Streets in the City of Portsmouth, Virginia; and <br /> WHEREA~ one of the obligations of the City of Portsmouth with respect to said project is the provision <br /> of the land necessary for the construction; and <br /> <br /> t~HEREAS, the City of Portsmouth has found it to be necessary to acquire the interest hereinafter <br /> specified in and to the hereinafter described ~arcels of land situate in the City of Portsmouth, Virginia, <br /> f~r the purpose of constructing, widening and ~mproving the aforesaid State Highway Route 58; and <br /> WHEREAS, the City of. Portsmouth has not been able to purchase the property described herein, necessary <br /> to the project, because the owners thereof and the City have not been able to agree unon the price to be paid <br /> therefor, or the City has not been able to locate certain of the owners or because of the status of the <br /> title of certain parcels of the property; and <br /> <br /> I;'HEREAS~ ad~ncement of the work and use of said State Highway Route 58 will be delayed unreasonabl~ if <br /> the said property is nQ~.~made available as soon as nossible. <br /> <br /> NOW, THEREFORE~ BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> Section 1. The City Attorney is directed to institute eminent domain oroceedings, emp~yin~ snecial <br /> counsel for that pu~ose if he deems ~it advisable, against the property hereinafter described located along <br /> State Highway Route 58, for the purpose of acquiring fee s~.~..ole title therein, together with a temporary <br /> construction easement in accordance with and ~ursuant to Section 25 IF] of the Charter of the City of <br /> Portsmouth [Chapter 229 of the Acts of Assembly of 1966], and to deposit to the credit of the court as <br /> vided by law the sum hereinafter specified to comnensate the~espective owners of the vsrious narcels of <br /> land, as shown on those certain nlans entitled PrOject 0058-124-102, R/W 201 and 202 dated February 14, 196~, <br /> sheets 9 and 12, a copy of which~ is filed with the Department of Public ~orks of the City of PoYtsmouth, <br /> <br />PARCEL N~ME AMOUNT <br /> <br />64 Florence Mary Maupin $1,595.00 <br />65 S. Pappas $1,,620.00 <br /> <br />Virginia. <br /> <br /> Section 2, The City Attorney is authorized to proceed against each individuI( parcel and the respective <br />owners thereof or against such combinations of parcels and the respective owners thereof as he shall deem <br />advisable;" <br /> <br /> 68-15~ - "Bids were opened on Thursday, May 9, for lease of the concession stand at the boat ramp in <br />City Park and ~'lso for the boat landing at the foot of High Street. <br /> One bid was received for the opemation of the concession stand at the boat ramp offering to pay the <br />City ~e $~ ~ $150 annually, beginning June t, 1968. I do not believe this to be sufficient rental for <br />this concession stand and I therefore recommend the hid be rejected. <br /> <br /> I have discussed this with the Director of Recreation and plans are being formulated to operate this con. <br />cession by the Recreation Bureau. <br /> <br /> <br />
