~ovem~er 26, 1968 <br /> <br />in and to the hereinafter described parcels of land situate in the City of Portsmouth, Virginia, <br />of constructing, widening and improving the aforesaid State Highway Route S8; and <br /> <br />for the purpose <br /> <br /> WHEREAS, the City of Portsmouth has not been able to ~urchase the property described herein, necessary to <br />the project, because the owners thereof and the City have not been able to agree upon the price to be paid there- <br />for, or the City has not been able to locate certain of the owners or because of the status of the title of <br />certain parcels of the property; and <br /> <br /> WHEREAS, advancement of tho work and use of said State Highway Route 58 will be delayed unreasonably if the <br />said property is not made available as soon as possible. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> Section 1. The City Attorney is directed to institute eminent domain proceedings, employing special counsel <br />for that purpose if he deems it advisable, against the property hereinafter described located along State Highway <br />Route 58, for the purpose of acquiring a temporary easement Ifl~e~im, in accordance w~h and pursuant to Section <br />25 (F) of the Charter of tko City of ?o~tsmout~ [CTaapter 22~ of the Acts of Assembly-of 1966), and to deposii to <br />the credit of the court as provided by law t~e sum hereinafter specified to compensate the respective o~mers of <br />the various parcels of land, as shown on those certain plans entitled Project 0058-124-102, R/W, 201 and 202 <br />dated February 14, 1966, sheet S, a copy of which is filed with the Department of Public Works of the 0ity of <br />Portsmouth, Virginia. <br /> <br />PARCEL NAME ~MOb~{T <br /> <br />272 Annie E. The City Attorney is authorgzed to nroceed against each individual parcel and the respective <br />o~s thereof or against such combinations of parcels and the respective owners thereof as he shall deem ad- <br />visable.'' <br /> <br /> 68-594 - "I submit the attached agreement between the Virginia Electiic and Power Company and the City of <br />Portsmouth and recommend the properCity officials be authorized to sign. <br /> <br />This agreement covers the installation of undergruund electrical service to the Riddick-Weaver School." <br /> <br /> Motion of Mr. Smith that tlie proper City officials be authorized to sign the agreement was adop~efl, wi~h'o~t <br />dissenting vote. <br /> a <br /> fi8-395 - "In/recent ~ity Council meeting, it was referred to me for study the feasibilty of widening High <br />Street, West, from the Churchland Bridge to Cedar Lane. <br /> <br /> The City Traffic Engineer and the Public ~orks Department have reviewed this matter and estimate the cost <br />to be $57,000.00. This would include the piping of all drai~aage ditches with a proposed depth greater than two <br />feet, tree removal and the seeding of la~rns that would be disturbed in the sKreet widening. <br /> <br /> It is further recommended by these two departments t~at th~s work be extended from Cedar Lane to Garland <br />Drive to tie in with the Chruchtand By-pass. This would be an additional ~,000 lineal feet of widening and would <br />increase the cost by an additional $40,000, or a total estimated cost of $97,000 to add one 1I foot land and a <br />:six foot shoulder to Nigh Street from Garland D%ive to Carney Street. <br /> <br /> The City Traffic Engineer advises me that this lane will serve to reduce some of the congestion now existing <br />on High Street, West, but it will not have the desired result of providing free traffic movement. The problem <br />creating the congestion begins at Churchland High ~chool where two-lane traffic is reduced to one-lane traffic. <br />The backup of automobiles begins before reaching Cedar Lane. This still will not eliminate the congestion caused <br />by turning movements,-nor will it eliminate the accident inherent with these turning movements. <br /> <br /> If this is to be done, it will be necessary for us to delay other street work. Due to the cost involved, I <br />recommend that this be referred to the I969-70 budget for further consideration." <br /> <br /> Motion of Mr. Smith to refer to the 1969-70 Budget for further consideration was adopted, wit5.,enedissentimg <br />vote - Mr. No~ley. <br /> <br />- UNFINISHED BUSINESS <br /> <br />68-~65 - The following ordinance, approved on first reading at last meeting, was taken up` and read: <br /> <br /> "AN ORDINANCE TO A~END SECTION 2-6 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1961, CHANGING <br /> THE MEETING DATE OF THE CITY COUNCIL." <br /> <br /> Motion of Mr. Smith that the ordinance be amended to delete the first meeting, on December S; to have one <br />meeting in ~ecember unless an emergency should arrive, was lost, there beiBg~no second. <br /> <br /> On motion of Mr. Turner, the ordinance was adopted by),the, following vote: <br /> <br /> Ayes: Barnes, Eastes, Holley, Johnson, Smith, Turner. <br /> Nays: None <br /> <br />68~364 - The following ordinance approved on first reading at last meet.ing, was taken up and read: <br /> <br />"AN ORDINANCE TO ;24END SECTION 62 OF THE LICENSE TAX ORDINANCE OF THE CITY OF PORTSMOLrrH, 1965, <br />IMPOSING A LICENSE TAX ON COIN-OPERATED 5L~CHINBS FOR CLEP~NING AND POLISHING SHOES." <br /> <br />On motion of Mr. Eastes, the ordinance was adopted and by the following vote: <br /> <br />Ayes: Barnes, Eastes, Holley, Johnson, Smith, Turner <br />Nays: None <br /> <br /> <br />
