<br />P34INBNT DOMAIN PROCEEDINGS PURSUANT TO C~TRR 229' OF THE ACTS OF ASSEMBLY ~ 1966, SAID PROPERTY
<br />BEING NECESSARY FOR THE C<)NSTRUCTION, WIDFNING AND IMPROV~4PANT OF STATE HIGHWAY ROUTE 58 FROM THE
<br />INTERSECTION OF AIRLINE BOULEVARD ~hND HIGH STREET TO THE I~rrERSF. CTION OF LONDON AND EFFINGHAM
<br />STREETS

<br /> ~'HEREAS, in cooperation with the Federal and State govero~ants, State Highway Route 58 is being constructed
<br />widened and improved from the intersection of Airline Boulevard and ~gh Street to the intersection of London
<br />and effingham Streets in the City of Portsmouth, Virginia; and
<br />
<br /> WHEREAS, part of the said highway has been designated as aLimited Access Highway in accordance with the
<br />provisions of Article 5, Chapter 1, Title 55, of the 195~ Code of Virginia as amended; and
<br />
<br /> ~EREAS, one of tko obligations of the City of Portsmouth with respect to said project is the provision
<br />of the land necessa~M for the construction; and
<br />
<br /> WHEREAS, the City of Portsmouth has found it to be necessary to acquire the interest hereinafter specified
<br />~nd to the hereinafter described parcel of land situate in t~e City of Portsmouth, Virginia, for the purpose
<br />of constructing, widening and improving the af6~esaid State ~gHway Route 58; and
<br />
<br /> WHEREAS, the City of Portsmeu~has not been able to purchase the property described herein, necessary to
<br />the project, becasue the owners thereof and the City Have not been able to agree upon the price to be paid
<br />therefor, or the City has not been able to locate certain of the owners or because of the status of the title
<br />of certain parcels of the property; and
<br />
<br /> WHEREAS, advancement of th~ work and use of said State Highway Route 58 will be delayed unreasonably if
<br />the said property is not made available as soon as possible.
<br />
<br /> Section 1. The City Attorney is directed to institute eminent domain proceedings, employing special
<br />counsel for that purpose if he deems it advisable, against the property hereinafter described located along
<br />State Highway Route 58 for the purpose of acquiring fee simple title therein, together with any and all
<br />easements of access, light, or air incident to the lands of the landowner abutting upon said Limited Access
<br />Highway and/or upon any of its ramps, loops, or connections at and with intersecting highways, in accordance
<br />with ~nd pursuant to Section 25 {F) ~ the Charter of the City of Portsmouth {Chapter 229 of the ~ct$ of
<br />Assembly of 1966) and to deposit to the credit of the court as prov~ed by law the sum Hereinafter specified
<br />to compensate the owners of the parcel of land, as shown on those certain plans entitled Project 0058-124-102,
<br />R/W, 201 and 202 dated February 14, 1968, sheet 12, a copy of which is filed with the Department of Public
<br />Works of the City of Portsmouth, Virginia.

<br />We have been unable to locate the owner of this property; therefore, the need for condemnation."
