December <br /> <br /> Ayes: Barnes, Holley, Johr~on, Tux~ner <br /> Nays: Eastes, Ki g, Sm£tH <br /> <br />Use Permit 68-25 - Petition of American 0il Company <br /> <br />Donald Pavony spoke. <br /> <br />On motion of Mr. Eastes, the following resolution was adopted, without dissenting vote: <br /> <br />"A RESOLUTION GRANTING A USE PER~iIT FOR THE~ OPERATION OF AN AUTOMOTIVE SERVICE STATION AT THE <br />CORNER OF HIGH STREET, WEST, AND TYRE NECK ROAD, UP 68-25 <br /> <br /> WHEREAS, THe American Oil Company has made an application pursuant to Section 4-2 6f the Zoning Ordinance <br />of the City of Portsmouth, 1961, for the granting of a use permit as hereinafter described; and <br /> <br /> I~EREAS, theapplicant, the Planning Director and the City Manager have done all things required to be <br />done in connection with said application, and the Plarming Comission has recomme~fled the granting of said <br />use permit, subject to the conditions hereinafter stated. <br /> <br />NON, THEREFORE, BE IT RESOLVED hythe Council of the City of Portsmouth, Virginia: <br /> <br />Ae <br /> <br />That the use for which the use permit hereinafter described is sought (1) will not adversely <br />affect the health or safety of persons residing or working in the neighborhood of the proposed <br />use, (2) will not be detrimental to the public welfare or injurious to property or improvements <br />in the neighborhood, and (5) will be in accord with the purposes of Said Zoning Ordinance. <br /> <br />That the Americam:Oil Company is hereby, granted ause permit, pursuant to Section 4-2 of said <br />Zoning Ordinance, for the purpose of constructing and operating an addition to an existing <br />and operating a~motive service station located on the property described as follows: <br /> <br />Beginning at the southwest corner of High Street, West and Tyre Neck Road; thence south along <br />the west right-of-way line of T~ Nech Road 15~ feet; thence west 150 feet; thence north 150 <br />feet to lligh Street, West; thence east along said street 150 feet to the point of ' ~ ~ <br /> origin. <br /> <br />Use Permit 68-26 - Petition of James V. Bickford <br /> <br />No one spoke in regard to the petition. <br /> <br />On motion of Mr. Johnson,. the following resolution was unanimously adopted: <br /> <br />"A RESOLUTION GRANTING A USE PERMIT FOR T[~ CONSTRUCTION AND OPERATION OF A SEWAGE PLB~ING <br />STATION ON PROPERTY IN THE CHURCHLAND ~ST SUBDIVISION, UP 68-26 <br /> <br /> WHEREAS, James V. RP-2, URBAN RENEWAL PROJECT VA. R-48, CODE NO. R-215"~: a <br />document to be cnnsidered for adoption as an amendment to the City of Portsmout5 Comprehensive Plan in terms <br />of further defining and clarifying CP-I-bb, the Land Use Plan for the Northslde General Neigtiborhood R~m~al <br />Plan. One purpose of this hearing will be to determine if there is any conflict between proposals contained in <br />the document noted above and the officially-adopted Comprehensive Plan. The area in question is bounded on the <br />north by Scott's Creek and the U. S. Naval Ho%nitat, on the east by the line of Parkview Avenue to Bay Street <br />from the U. S. Naval Hospital; Bay Street from Parkview Avenue to a line along tke rear of properties fronting <br />Elm Avenue to Ann Street; Ann Street to Fort Lane, Fort Lane from Ann S~reet to NortHside No. 1, on the south <br />by Northside No. 1, and on the wes~ by Oak Grove Cemetery and Scott's Creek. <br /> <br /> Motion of Mr. Smith to concur in the recommendation of the Planning Con~nlssion to approve the amendment <br />~prS~mpthhensive Plan, was adopted, without dissenting vote. <br /> <br />The following reports from the City Manager were read: <br /> <br /> 68-411 - "I submit the attached ordinance and recommend it he placed on first reading. This appropriates <br />$5,500.00 for improvements to the Health Department building at Green and London Streets. <br /> <br /> <br />
