<br /> IfllEREAS, Cherry Realty Corporation and Portsmouth Redeveloomeut and Housing Authority have made appli-
<br />cation to vacate and a~ose that hereinafter described portion of a certain street located on the South side
<br />of South Street and it appearing that notice of the application and request for the appointment of viewers
<br />was duly posted on December 21, 1968, on the bulletin board of the Court oflfust~"g~for the City of Portsmouth
<br />on the bulletin board of the Circuit Court of the City of Portsmouth, and on the bulletin board of the
<br />Municipal Court of the City of Portsmouth.

<br /> NOW, TI~REFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that Luther Tapp, Jame:
<br />Choate, Joseph Kiss, Zalmon I. Blachman and Nellie K. Walke be appointed viewers to view the hereinafter
<br />described portion of a certain unnamed street and report to th~ Counnil in writing whether in their opinion
<br />any, and if any, what inconvenience would result from vacating and closing the following portion of the
<br />specified street:

<br />That certain forty foot roadway leading from the South side of South Street to the
<br />property formerly belonging to the City of P~et$mmouth for use as the City Incinerator,
<br />the center line of which is described as beginning at a point on the South side of
<br />South Street seventy-six feet fifteen inches from the Soatheast intersection of South
<br />Street and Prentis Avenue; thence South 17°14~47" East two hundred four feet to the
<br />Southern boundary line of Portsmouth Redevelopment and HOusing Authority Project VA-
<br />1-5, and is the last street dedication on page 5 of that certain deed of dedication
<br />duly recorded in Deed Book 273, page 182, Clerk's Office of the Court of Hustings for
<br />the City of Portsmouth, Virginia."

<br /> These are all paper streets and have never been opened. The Planning Commission has approved these

<br />described portions of certain streets located in the subdivision of Washington Heights and it appearing that
<br />notice of the application and request for the appoin~aten~ o£ view, rs was duly posted on December 2, 1968 on
<br />the bulletin board of the Court of Hustings for the City of Portamouth, on the bulletin board of the Circuit
<br />Court of the City of Portsmouth and on the bulletin board of the Municipal Court of the City of Portsmouth.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that Luther Tapp,

<br />the East by the Eastern perimeter boundary line of Washington Heights, as
<br />shown on said plat, and on the West by the Eastern right of way line of
<br />Grogan Avenue; lB) and on the ~ast by the Western right of way line of Cut-
<br />off Avenue, and on the West by the Western per~aeter boun~a~F line of
<br />Washington Heights, as ~hown on said plat;
