<br /> Section 2, Full power and authority is hereby given to the City Manager of the. City of Portsmouth to pre-

<br /> Section $. The bonds authorized by this resolution shall not be included in determining the limitation
<br />upon the power of the City to incur Indebtedness under the provisions of Section One Hundred and Twenty-seven,
<br />Clause {b], of the Constitution of Virginia, but from and after November 7, 1966~ whenever and for so long as
<br />the water works system constructed and improved out of proceeds of said bonds fails to produce sufficient re-
<br />venue to pay the cost of operation and administration, {including interest on bonds issued therefor, and the
<br />cost of insurance against loss or injuries to persons and property), and an annual amot~t to be covered into a
<br />sinking fund sufficient to pay at or before maturity all bonds issued on account of said water works pystem,
<br />all such bonds outstanding shall be included in determining the limitation upon the power of tb~ City of Ports-
<br />mouth to incur indebtedness.

<br />Section 4. This resOlution shall take effect from its passage."

<br />BEING NECESSARY FOR THE CONSTRUCTION, WtD~It~G AND. I~w~ROVEA~NT OF STATE ~IG~AY RouTE 58 FROM THE
<br />INTERSECTION OF AIRLINE BOULEVARD ;~qD HIGH STREET TO THE INTERSECTION OF LONDON AND EFFINGHAM

<br /> Pa~EREAS, in cooperation with the Federal and State governments, State Highway Ro~e 58 is being constructed
<br />~i~ne~ an~ imp~o~e~ ~om %h~ iR~ersec-t~n of 5d~(hl~d :E~i~fi~t~g in the City of Portsmouth, Virginia;
<br />and
<br />
<br /> WHEREAS, one of the obligations of the City of Portsmouth with respect to said project is the provision
<br />of the land necessary for the construction; and
<br />
<br /> WHEREAS, the City ~6 Portsmouth has found it to be necessary to acquire the interest Hereinafter specified
<br />in and to the hereinafter described parcels of land situate in the City of Portsmout~ Virginia, for the put-,
<br />pose of const~cting, widening and improving the aforesaid State Highway Route 58; and
<br />
<br /> I~HEREAS, the City of Portsmouth has not been able to purchase the property described herein, necessary to
<br />the project, because the owners thereof and the City have not been able to agree upon t~ price to be paid
<br />therefor, or the City has not been able to locate certain of the owners or because of the status of the title
<br />of certain parcels of the property; and
<br />
<br /> ~HHRBAS, advancement of the work and use of said State Highway Route 58 will be delayed unreasonably if the
<br />said property is not made available as soon as possible,
<br />
<br />'NOW, THEREFORE, BE IT P~SOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br /> Section 1. The City Attorney is directed to institute eminent domain proceedings, employing special
<br />counsel for that purpose if he deems it advisable, against the property hereinafter described located along
<br />State H~ghway Route 58, for the purpose of acquiring fee simple title therein, in accordance with and pursuant
<br />to Section 25 (F) of the Charter of the City of Portsmouth (Chapter 22~ of the Acts of Assembly of 1966), and
<br />to deposit to the credit of the court as provided by law the sum hereinafter specified to compensate the respect~
<br />
