This authorizes the CiTy Manager to execute the formal contract be- <br />tween the Department of Housing and Urban Development and the Cilty of Portsmouth." <br /> <br />On motion of Mr. Smith, the following resolution was adopted, without dissenting vote: <br /> <br />"RESOLUTISN APPROVING AND PROVIDING FOR EXECUTION OF PROPOSED NEIGHBO~]OOD FACILITIES GRANT <br />CONTRACT ON A (TWO-THIRDS) BASIS NUMBERED CO~ITRACTNO. VA. M-7(G), BE~gEEN CITY OF PORTb~UTH <br />AND THE UNITED STATES OF ~ERICA, PERTAINING TO A CERTAIN NEIGHBOR~{OOD FACILITIES GRP~NT <br />PROGR~4 DESIGNATED PROJECT NO. VA. N-7 <br /> <br /> WHEREAS, under Title I of the Housing Act of 1949, as: amended, the United States of America ~herein <br />called the "Government") has tendered to City of Portsmout~ (her~in called the "Public ~od~~) a proposed <br />Grant Contract pursuant to which the Government would extend certain financial assistance to the Public Body <br />in connection with the program described therein; and <br /> <br />?~EREAS, the ~ublic Body has given due consideration to said propesed contract; and <br /> <br /> IqHHREAS, the Public Body is duly authorized, under and pmmsuant to the Constitution and laws of the <br />Commonwealth of Virginia, to undertake and carry out said project and to execute such proposed contract. <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PORTSMOUTH, VIRGINIA, AS FOLLOWS: <br /> <br /> Section 1. T~e proposed Contract, designated '~eighborhood Facilities Grant Contract, ContractNo. <br />VA. N-7(G)," providing for the making by the Government to the Public Body of a Neighborhood Facilities Grant <br />under Title I of the Housing Act of 1949, as amended, in connection with the program, described therein and <br />designated as Project No. VA. N-7 is hereby in all respects approveff. <br /> <br /> Section 2. The City Manager is hereby authorized and directed to execute said proposed Contract in two <br />counterparts on behalf of the Public Body, and the City Clerk ishereby authorized and directed to impress <br />and attest the official seal of the Public Body on each such counterparts and to lo,card such counterparts <br />to the Department of Housing and Urban Development together withsuch other documents relative to tb~ approval <br />and execution thereof as may be required hythe Government. <br /> <br /> Section 5. The City Manager is hereby authorized to file requisition, togetherwith necessary supporting <br />documents with the Government, in accordance with the Contract, requesting payments to be made on account of <br />the Neighborhood Facilities Grant provided for in the Contract and to do or perform all other t~nings and acts <br />required to be done or performed in order to obtain such payments. <br /> <br />Section 4. This Resolution shall take effect immediately." <br /> <br /> 69-51 - "I submit the attached agreement between the City of Chesapeake and the City of Portsmouth and <br />recommend the proper City officials be authorized to sign. This is a Mutual Aid Firefighting Agreement ba~ <br />tween the two cities. <br /> <br /> In the event of a fire occurring in Portsmouth requiring Chesapeake Fire Depm~nt assistance, the <br />Chesapeake Fire Department and its personnel will respond under the direction of the~ suoervisor and take <br />directions from the Portsmouth Fire Department's senior supervisor present. <br /> <br /> In the event of a fire occurring in Chesapeake requiring Portsmouth Fire Department assistance, our fire- <br />fighting equipment and its personnel will respond under the direction of their s~pervisor and take directions <br />from the Chesapeake Fire Department's emptor supervisor present. <br /> <br /> Neither department will resnond unless specifically called to do so. Each party to this agreement waives <br />all claims against the other party for any loss, damage, personal injury or death occurring in consequence of <br />the performance of this agreement." <br /> <br /> Motion of Mr. Smith that the proper city officials be authorized to sign the agreement ~as adopted, <br />without dissenting vote. <br /> <br />- UNFINISHED BUS1NHSS - <br /> <br />69-1 - The following~ordinance, approved on first reading at last meeting was taken up and read: <br /> <br />"AN ORDINANCE TO M~END THE ZONING ORDINANCE OF THE CITY OF PORTS~OUI~i, 1961, BY AMENDING SECTIONS <br />2-1 and 5-7 THERH~F AND BY ADDING THERETO A NEW SECTI[~N NUMBERED 4-9.1, CREATING A NE~ RHSID~Nrf~AL <br />OFFICE ZONING DISTRICT, DESIGNATED OFFICE RESIDENTIAL 0R-75 AND ESTABLISHLNG THE REQUIREU~NTS <br />THEPJ~OF." <br /> <br />On motion of Mr. $ohnson, the ordinance was adopted, and by the following vote: <br /> <br />Ayes: Barnes, Holley, Johnson, King, Smith, Turner, Eastes <br />Nays: None <br /> <br />69-1 - The following ordinance a~proved on first reading at last meeting, ~as taken up and read: <br /> <br />"ZONING AN~NDMF~NT ORDINANCE Z 68-$5" <br /> <br />On motion of Mr. Eastes, the~ordinance was adopted, and by the following vote: <br /> <br />Ayes: Barnes, Hastes, Holley, Johnson, King Smith, Turner <br />Nays: None <br /> <br /> <br />
