h~)M TItEREFORE, BE IT RESOLVED by the Council of the Cityof Portsmouth, Virginia: <br /> <br />.T~at the use for which the use permit~aerelnafter descr£bed is sought (11 will not adversely <br />affect the health or safety of persons resid~g or werkt'ng in the neighborhood of the proposed <br />use, (2) will not be detrimental to the public welfare or injurious to property or improvements <br />in the neighborhood, and KS) will be in accord with the purposes of said Zoning Ordinance. <br /> <br />That Merrifields Mater Company, Inc. is hereby granted a use permit, subject to site plan <br />restrictions, pmrsuant to Section 4-2 of said Zoning Ordinance, for the construction and operation <br />of a water pumping station on property in the subdivision of Merrifields and more particularly <br />described as follows: <br /> <br />Beginning at a point on the east right-of~way line of Forresthills Drive approximately 374 <br />feet woth of the southeast corner of Burrland Road and Forresthills Drive; thence northeast <br />12S feet to a rear lot line; thence southeast 90 feet to a point; thence southwest 125 feet <br />to the east right-of-way line of Forrestkills Drive; thence northwest along said right-of-way <br />line 90 feet to the point or origin." <br /> <br />The following reports from the City Manager were read: <br /> <br /> 69-26 - ~'I submit the attached ordinance and recommend it be placed on first reading. This amemds <br />Section $7A-$I of the City Code, pertaining to the fee charged for tee restoring of service for water when <br />it is disconnected for non-payment. <br /> <br /> At the present time, we are cha~ging a fee of $1.~0 ~orestore service when it is disconnected for non- <br />payment. Many customers gamble in not paying the bill on time as they know there is only a $1.DQ charge <br />if it is disconnected. The $1.00 charge does not cover the cost of handling the nonpays since two trip~ <br />are necessary to a premise when the bills are not paid. Revenue from the customers who pay promptly should <br />not help absorb losses associated with the non-pays." <br /> <br /> On motion of Mr. Johnson, the following ordinance was a approved on first reading, with one dissenting <br />vote - ~r. Turner: <br /> <br /> ORDINANCE TO AMEND SECTION $7A-St OF TH~ CODE OF TklR CITY OF PORTSMOUTH, VIRGINIA, 1961, <br />INCP~EASING THE FEE FOR TURNING ON WATER SERVICE AFTER SUCH SERVICE HAS BEEN TBRMINATED FOR <br />NON-PAYMEI,ff." <br /> <br /> 69-27 - "I submit the attached ordinance and recommend it be placed on first reading. This amends <br />Section 11~24 of the City Code regardinggTenalties for the violation of the F~re Prevention Code. <br /> <br /> This is a technical amendment where the worm "prder"is be~g substituted for the word "other" on <br />the fourth line in this section of the Code;" <br /> <br /> On motionof Mr. Hastes, the following ordinance was a~roved on first reading, without dissenting <br />vote: <br /> <br />"~40RDtN~qCE AqBNDING SECTION 11-24 OF THE CODE OF Tt4~ CITY OF PORTSMOUTH, VIRGINIA, 1961, <br />PERTAINING TO THE PENALTY FOR VIOLATION OF THE FIRE PREVMNTION CODE." <br /> <br /> 69-28 - "I submit the g%tached resolution and recommend its adoption. Tb~s vacates a subdivision <br />plat of Nottingham Forest, recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake, <br />Virginia. The vacation of this plat has been approved by thePlanning' Commission.' ' " <br /> <br />On motion of Mr. King, the following resolution was adopted, with one abstain~.g vote - Mr. Smith: <br /> <br />"RESOLUTIMN CONSFaNTtNG TO THH VACATIDN OF Tt~ SUBDIVISION PI,AT OF NOTTINGHAM MORBST <br /> <br /> WHEREAS, a certain plat of a subdivision of land entitled, Nottingham Forest , was duly recorded in <br />the Clerk's Office of ~he Circuit Court of the City of Chesapeake, Virginia, in Map Book 48, at page 96; <br />and <br /> <br /> WHEREAS, through annexation proceedings the aforesaid subdivision of land became a part of the City <br />of Portsmouth, Virginia, on January 1, 1968; and <br /> <br />WHEREAS, no lot within the said subdivision of Nottingham Forest has been sold; <br /> <br /> NOW THEREFORE, be it resolved t~at the Council of the City of Portsmouth, VirginiA, consents to the <br />vacation of the aforesaid plat in its entirely in accordance With the provisions of Section 15.1-481, <br />Code of Virginia, 1950, as amended." <br /> <br /> 69-29 - "The Southeastern Virginia Regional Planning Commission has requested approval by the Portsmouth <br />City Council of an amendment to the Suffolk bypass highway plan. The specific amendment is the elimination <br />of an interchange on the approved northeast quadrant of the Suffolk bypass at its intersection with 337 north- <br />east of Magnolia. <br /> <br /> The elm,nation of this interchange has been approved by the Southeastern Virginia Regional Planning <br />Com~nission and it r~quires the approval of all of the political subdivisions that are members Of this commis~ <br /> <br /> Motion of Mr. Johnson to concur in the recommendation of the City Managem was adopted, without dissenting <br />vote. <br /> <br /> 69-$0 - "I submit the attached resolution and recommend its adoption. This approves the execution <br />a Neighborhood Facilities Grant between the City of Portsmouth and the United States of America. <br /> <br />grant is for the improvementsto the old Armory.
