Sec. $8-6.1. It shall be unlawful for any person to carry any loaded firearm in any public place, except
<br />on legally open hunting groumd$ and at anti, or,zed target sRooting ranges. Upon a conviction of a violation
<br />of this section, any such firearm, togetRer wi~c,%i ~Re anununtioniintended for use therc~ith, may, in the dis-
<br />cretion of the court trying the case, be forfeited to the city by order duly entered, and may be seized by
<br />an officer as forfeited, and such as may Be needed for police officers and conservation of the peace shall be
<br />devoted to that purpose, and the remainder s~all Be ~estroyed by the officer having them in charge.
<br />
<br /> This section shall not apply to any police officers, sergeants, sne~Iffs, conservator of the peace other
<br />than notaries public, or to carriers of United States mail, or to any collecting officer while in the dis-
<br />charge of his official duty, or to any person permitted by court order to carry a concealed weapon.
<br />
<br />Sec. 38-7. If any person shall sell, barter, give or funish, or cause to be sold, bartered, given or
<br />furnished, to any minor under eighteen years of age, a pistol, dirk or bow~ knife, having ~ood cause to
<br />believe him to be a minor under eighteen years of age, he shall, upon conviction, be fined not less than two
<br />dollars and fifty cents nor more than one hundred dollars.
<br />
<br />Sec. 38-8. No person shall sell, barter, exchange, furnish or dispose of by purchase, gift or in any other
<br />manner any toy gun, pistol, rifle or other toy firearm, if the same shall, by means of powder or other
<br />explosive,-discharge blank or ball charges. Any person violating the provisions of this section shall be
<br />guilty of a misdemeanor, and, upon conviction thereof, shall be fined not less than fifty dollars nor more
<br />than one hundred dollars, or confined in jail for a period not less than thirty days nor more than ninety
<br />days, or both. Each sale of any of the articles hereinbefore specified to any person shall constitute a
<br />seoarate offense.
<br />
<br /> Nothing in this section shall be construed as preventing the sale of what are commonly known as cap
<br />oistols.
<br />
<br />Sec. 38-9, No person shall sell, rent, give or othe~.~ise furnish (hereinafter referred to as "sell") to any
<br />person within the city any pistol, dirk, Bowie knife, slungshot, switchblade knife or any weapon of a like
<br />kind, unless and until the recipient thereof [heceinafter referred to as"purchaser") shall present to such
<br />oerson (hereinafter referred to as "dealer") a permit granted by the chief of police authorizing the purchaser
<br />to ourchse or gcquire such weapon.

<br />Sec. 38-10. Whenever the applicant for a permit as required in section 58-9 produces a certified order of
<br />the judge of the fiourt of Hustings authorizing the applicant toccarry the subject weapon as a concealed
<br />weapon, the chief of police shall issue such permit.
<br />
<br /> In cases where the subject weapon is not to he. cgrri~d as a concealed weapom, the chief of police shall
<br />issue the permit to ourchase or acquire s~oject to tile following regulations:
<br />
<br />(1) The applicant must personally sign and complete a written aoplicationPfor the permit.
<br />
<br />(2) The applicant must be fingerprinted by tSh police denartment.
<br />
<br />A report of the police records of the applicant must be obtained by the nolice department from the
<br />Federal Bureau of Investigation.
<br />
<br />{4) The applicant must show a lawful use for the subject weapon.
<br />
<br /> (5) When such investigation discloses that the public welfare will be prejudiced by permitting a
<br />person of known metal instability or criminal activity involving breach of the peace, such a permith shall not
<br />be granted.
<br />
<br />Sec. 38-11. All dealers in pistols, dirks, Bowie knives~ switchblade knives or any weapon of like kind shall
<br />keep an accurate register of the number and character of such weapena purchased, name of person from whom
<br />purchased and date of purchase, and likewise keep an accurate record of each sale of such weapon, which shall
<br />show the date of sale, the name of the purchaser and the number and character of the w~apon. Such records
<br />shall be onen to the inspection of any police officer of the city, and a copy of the same shall be made and
<br />certified by such dealer monthly to the chief of police. Upon the sale of each such weapon, the dealer shall
<br />secure from the purchaser the pennit to Lma~dh~or acquire the same and shall forward such permit with
<br />appropriate notation of the sale to the chief of police by personal delivery or by letter postmarked not later
<br />than 11 A.M. of the second day following such sale.

<br />STATE ENACTMENTS PERTAINING TO FIREAP~q REGULATION AND CONTROL
<br />
<br />Sec. 18.1-66. If any person maliciously discharges a firearm within any building when occupied by one or more
<br />persons in such a manner as to endanger the life or lives of such person or persons, the person so offending
<br />shall, u~on conviction thereof, be punished ~y confinement in the penitentiary for not less than one nor more
<br />than ten years. ~ If any such act be committed unlawfully, but not maliciously, the person so offending shall,
<br />upon conviction thereof, be punished by confimement in the penitentiary not less than one nor more than three
<br />years, or, in the discretion of the jury or the court trying the case without a jury, be confined in jail not
<br />to exceed twelve months and fined not less than one hundred dollars nor more than five hundred dollars.
<br />
<br />Sec. 18.1-68. If any person, in the commission of, or attempt to com~it, felony, unlawfully shoot, stab, cut
<br />or wound another person he shall be confined in the penitentiary not less than one nor more than five years,
<br />or, in the discretion of the ]ury or the court ~rying the case without a jury, be confined in jail not ex-
<br />ceeding one year or fined not exceeding five hundred dollars, either or bo~h.
<br />
<br />Sec. 18.1-69. If any person wilfully discharge or cause to be discharged any firearm in any street in a city
<br />or town, or in any place of public business or place or public gathering, he shall be guilty of a misde-
<br />meanor; provided, that this section shall not apply to any law enforcement officer in the nerformance of his
<br />official duties nor to any other person whose said wilful act is otherwise justifiable or ~xcusable at law in
<br />the Drotection of his life or property, or is othe~.~ise specifically authorized by law.

<br />Sec. 18.1-69.1. It shall be unlawful for any person to set or fix in any manner any firearm or other deadly
<br />weaoon so that it may be discharged or activated by a person coming in contact therewith or with any string,
