<br /> ~EREAS, the City of Portsmouth has found it to be necessary to acquire the interests hereinafter specified
<br />in and to the hereinafter doseribed parcel of land situate in the City of Portsmouth, Virginia, for the purpose
<br />of Constructing, widening and improving the aforesaid State Highway Route 58; and
<br />
<br /> WHEREAS, the City of Portsmouth has not been able to purchase the property described herein, necessary to
<br />the project, because of the status of the title of the property; and
<br />
<br /> WHEREAS, advancement of the work and use of s.aid State Highway Route S8 will be delayed unreasonably if the
<br />said property is nog made available as soon as possible.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br /> Section 1. The City Attorney is directed to institute eminent domain proceedings, employing special counsel
<br />for that purpose ~f he deems it advisable, against the property hereinafter described located along State High-
<br />way Route 58, for the purpose of acquiring fee simple title therein, together with any and all easements of
<br />access, light, or air incident to the lands of the landowner abutting upon said Limited Access Highway and/or
<br />upon any of its ramps, loops, or connections at and with intersecting highways, in accordance with and pursuant
<br />to Section 25 (F) of the Charter of the City of Portsmouth (Chapter 229 of the Acts of Assembly of 1966), and
<br />to deposit to the credit of the court as provided by thw the sum hereinafter specified to compensate the owners
<br />of the parcel of land, as shown on those certain plans entitled Project 0058-I24-102, R/W 201 and 202 dated
<br />February 14, 1966, sheets $ and 5, a 9opy of which is filed with the Department of Public Works of the City of
<br />Portsmouth, Virginia.

<br /> 69-165 - "We are about to embark on an extensive Codes enforcement program in the Mt. Hermon sections of
<br />the City. This is a pilot project where the inspectors will remain in the area for at least one year assisting
<br />the residents to upgrade the housing. Along with this, we would like to obtain as many Federal grants as
<br />possible that will assist this program.
<br />
<br /> I, therefore, recommend that the PortSmouth Redevelopment and Housing Authority be requested to study this
<br />progra~ and investigate what Federal programs can be applied for that will assist this project. Also, I re-
<br />commend that the HOusing AUthority proceed with the preparation of applications for any funds that are available
<br />
<br /> Motion Of Mr. Smith, to concur in the recommendation of the City Manager, was adopted without dissenting
<br />vote.

<br /> Action on this petition was deferred at a meeting held on December 17, 1968 to this date.
<br /> On motion of Mr. Johnson, interested persons were granted the privilege of the floor.
<br /> Attorney Louis Brenner spoke stating that R-75 will be satisfactory.
<br />
<br /> Herman Williams,c~r. of 222 Mayflower Road, spoke in opposition.
<br />
<br /> Motion of F{r. Johnson that the intersection of Hodges Ferry Read and Portsmouth Blvd., northwest corner,
<br />be considered by the Planning Commission for continuous zoning to the adjacent southwest corner and that a
<br />public hearing be held to determine the course of action, was lost, there being no second.
<br />
<br /> Motion of Mr. Eastes that the Council consider Petiti°n Z 68-31 for approval on first reading, rezoning
<br />to R-75.
<br />
<br /> Substitute motion of ~4r. Johnson to refer back to the Planning Comanlssion for ~ recommendation for proper
<br />zoning, the recommendation to be submitted within two months, was ~adopted, without dissenting vote.
