<br />construction of basketball courts.

<br /> These funds will equip f~ve neighborhood playgrounds. It will provide a black-top basketball court
<br />and playgroundequipment such as swings, slides, etc. This will not provide a comelete tot-lot such as
<br />that in City Park. Howev~m, ~t will not pro~de basic playground equipment which can be added to in the
<br />future. It is proposed to place this equipment in the Southside area, Brighton area, Western Branch area,
<br />Cavalier Manor and South Mt. Hermon."

<br />Section 15-29 and 1S-S1 of the Code of the City pertaining to the issuance of licenses for land fill opera-
<br />tions. This provides an annual fee schedule as follows:

<br />Up to 5,000 sq. ft.
<br />Over S,000 sq. ft. to 10,000 sq. ft.
<br />Over 10,000 sq. ft. to 20,000 sq. ft.
<br />Over 20,000 sq. ft. to 1 acre

<br /> This is a reduction in the current fees as we have found that the present fees are unrealistic and

<br /> 69-181 - "I submit the attached resolution and recommend its adoption. This authorizes condemnation
<br />proceedings for property located in the right-of-way of the London-Glasgow Street highway. These condemna-
<br />tion proceedings are necessary as we have not been able to agree on price with the ~ner~"

<br />On motion of Mr. Smith, the following resolution was ~dopted, without dissenting vote:

<br />"A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY OF PORTSMOUTH
<br />UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO CHAPTER 229 OF THE ACTS OF ASSEMBLY OF 1966,
<br />SAID PROPBRTY BEING NECESSARY FOR THE CONSTRUCTION, WIDENING AND I~0RROVEMENT OF STATE HIGHWAY
<br />ROUTB S8 FROM THE INTERSECTION OF AIRLINE BOULEVARD AND HIGH STREET TO THE INTERSECTION OF
<br />LONDON AND EFFINGHA3~ STREETS
<br />
<br /> WHEREAS, ~n cooperation with the Federal and State governments, State Highway Route 58 is being con-
<br />structed, widened and improved from the intersection of Airline Boulevard and High Street to the intersection
<br />of London and Effingham Streets in the City of.Portsmouth, Virginia; and
<br />
<br /> WHEREAS, part of said highway has been designated as a Limited Access Highway in accordance with the
<br />provisions of Article 5, Chapter 1, Title 55, of the 1950 Code of Virginia as mmended; and
<br />
<br /> ~iEREAS, one of the obligations of the City of Portsmouth with respect to said project is the provision
<br />of the land necessary for the construction; and
<br />
<br /> WHEREAS, the City of Portsmouth has found it to be necessary to acquire the interests hereinafter
<br />specified in and to the hereinafter descl~ibed ~-a~eel.~of~l~a~t~teh~n>~pc~it.~of~e~tsmot/t~, Virginia, fe~
<br />the[pu~oS~o$:.?epm~t~ctn%~g, widening and improving the aforesaid State Highway Route S8; and
<br />
<br /> WHEREAS, the City of Portsmouth has not been able to purchase the property described herein, necessary
<br />to the project, because of the status of the title of the property; and
<br />
<br /> WHEREAS, advancement of the work and use of said State Highway Route 58 will be delayed unreasonably if
<br />the said property is not made available as soon as possible.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the Eity of Portsmouth, Virginia:

<br /> Section 1. The City Attorney is directed to institute eminent domain proceedings, employing special
<br />counsel for that purpose if he deemsiit advisable, against the property hereinafter described located along
<br />
