3'~me 2d_ 1969 <br /> <br /> WHEREAS, in accordance with Section F of the said Plan, it so provides that said Redevelopment Plan may <br />be amended by.the Portsmouth Redevelopment and Heusing Authority with the consent of the City Council; and <br /> <br /> ~[EREAS, the Portsmouth Redevelopment and Housing Authority in undertaking the execution of Project No. <br />Va. R-SS has found it necessary to make minor changes to said Redevelopment Plan; and <br /> <br /> WHEREAS, the Portsmouth Redevelopment and Housing Authority has approved the changes to the Redevelopment <br />Plan by resolution which Plan dated February, 1969, together with said resolution has been referred to City <br />Council for review and approval and the City Council has duly conSidered said Redevel0pmentPlan; <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PORTSMOLrFH, VIRGINIA, as follows: <br /> <br />1. That said Redevelopment Plan, as amended, dated May, 1969, for the Project aforementinned, having <br /> been duly reviewed and considered is hereby approved. <br /> <br />2. That the City Clerk be and is hereby directed to file said copy of said Redevelopment Plan with the <br /> minutes of this meeting." <br /> <br /> 69-205 - "I submit the attar, bed resolution and recommend its adoption. This authorizes the execution <br />of contracts for improvements to Bffingham Street between the State Highway Department and the City of <br />Portsmouth. <br /> <br /> This Highway Department has accepted the bid on this project after two previous rejections. It is <br />anticipated that this project will begin construction within the very near future." <br /> <br />On motimn of Mr. Turner, the following resolution was adopted, without dissenting vote: <br /> <br />"RESOLUTION AUTHORIZING EXBCUTION OF CONTRACTS FOR IMPROVEMENTS TO EFFINGHAM STREET, PROJECT <br />O141-124-101, C-S01 AND 0141-124-102, C-501 <br /> <br /> ~dEREAS, the City of Portsmouth has heretofore requested the Virginia Department of Highways to <br />make certain improvements to Effingham Street in the City of Portsmouth; and <br /> <br />WHEREAS, City must share in the cost of the project with the Virginia Department of Highways. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that A. P. Johnson, Jr. <br />City Manager, is hereby authorized and directed to execute such contract or contracts as may be required by <br />the Virginia Department of Highways in connection with the construction of the improvements to Bffingham Street <br />Projects 0141-124-101, C-S01, and 0141-124-102, C-S01." <br /> <br /> 69-206 - "I <br />ceedings for two <br />an agreement for <br /> <br />submit the attached resolution and recommend its adoption. We have been unable to reach <br />the price of this property." <br /> <br />On motion 8~ Mr. King, the following resolution was adopted, without dissenting vote: <br /> <br />"A RESOLUTION TO ~i~VIDE FOR THE ACQUISITION OF CEMrAIN PROPERTY BY TIiE cITY OF PORTSMOUTH <br />UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO CHAPTER 229 OF THE ACTS OF A~SEMBLY OF 1966, <br />SAID PROPERTY BEING NECESSARY FOR THE C~NSTRUCTION, WIDENING AND IMPROVEMENT OF STATE <br />HIGHWAY ROUTE S8 FROM THE INTERSECTION OF AIRLINE BOULEVARD AND HIGH STREET TO THE INTER- <br />SECTION OF LONDON AND EFFINGHAM STREETS <br /> <br /> WHEREAS, in cooperation with the Federal and State governments, State Highway Route 58 is being con- <br />strutted, widened and improved from the intersection of Airline Boulevard and High Street to the intersection <br />of London and Effingham Streets in the City of Portsmouth, Virginia; and <br /> <br /> WHEREAS, part of said highway has been desingated as a Limited Access Highway in accordance with the <br />provisions of Article $, Chapter 1, Title 35, of the 1950 Code of Virginia as amended; and <br /> <br /> I~EREAS, one of the obligations of the City of Portsmouth with respect to said project is the provision <br />of tke land necessary for the construction;and <br /> <br /> $~4~REAS, the City of Portsmouth has found it to be necessary to acquire the interests hereinfter <br />specified in and to the hereinafter described parcel of land situate in the City of Portsmouth, Virginia, for <br />the purpose of constructing, widening and improving the aforesaid State Highway Route 58; and <br /> <br /> WHEREAS,. advancement of th2 work and use of said State Highway Route 58 ~511.he delayed unreasonably if the <br />said property is not made available as soon as possible. <br /> <br />NOW, THEREFORE, BB IT RESOLVED by the Council of the City of Portmmouth, Virginia: <br /> <br /> Section 1. The City Attorney is directed to institute eminent domain proceedings, emplbying special <br />counsel for that purpose if he deems it advisable, against the property hereinafter described located along . <br />State Highway Route 58, for the purpose of acquiring fee simple title therein, together with any and all ease~ <br />ments of access, light, or air incident to the lands of the landowner abutti~g upon siad Limited Access High- <br />way and/or upon any of its ramps, loops, or connections at and with intersecting highways, in accordance with <br />and pursuant to Section 23 (F) of the Charter of the City of Portsmouth (Chapter 229 of the Acts of Assembly <br />of 1966), and to deposit to ~He credit of the court as provided by law the sum hereinafter specified to com- <br />pensate the owners of the parcel of land, as shown on those certain plans entitled Project 0058-124-102, R/W <br />2~1 and 202 dated February 14, 1966, sheets 12 and 20 respectively, copies of which are filed with the Depart- <br />ment of Public Works of the City of Portsmouth, Virginia. <br /> <br />PARCEL NA~ AMOUNT <br /> <br />096 Harry W.
