<br /> On ~otion of Mr. Johnson, the follpwing resolution was unanimously adopted:
<br /> "A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY OF PORTSMOUTH UNDER EMINE~rf
<br /> DOMA/N PROCEEDINGS PURSU;~T TO CHAPTER 229 OF THE ACTS 89FASSEMBLY OF 1966, SAID PROPERTY BEING NECESSARY
<br /> FOR TH~ CONSTRUCTION, WIDENING AND Ib{PROVEb~NT OF STATE HIGHWAY ROUTE 58 FROM THE INTERESECTION OF
<br /> AIRLINE BOULEVARD AND HIGH STREET TO THE INTERSECTION OF LONDON ;~ND EFFINGHAM STREETS
<br />
<br /> WHEREAS, in cooperation with the Federal and State governments, State Highway Route S8 is being constructed
<br />widened and improved from the intersection of Airline Boulevard and High Street to the intersection of Lo~don
<br />and Effingham Streets in the City of Portsmouth, Virginia; and
<br />
<br /> ~HEREAS, part of said highway has been designated as a Limited Access Highway in accordance with the pro-
<br />visions of Article $, Chapter 1, Title 53, of the 1950 Code of Virginia as amended; and
<br />
<br /> WHEREAS, one of the obligations of the City of Portsmouth with respect to said project is the provision
<br />of the land necessary for the construction; and
<br />
<br /> WHEREAS, the City of Portsmouth has found it to be necessary to acquire the interests hereinafter specified
<br />in and to the hreinafter described parcel of land istuate in the city of Portsmouth, Virginia, for the purpose
<br />of constructing, widening and improving the aforesaid State Highway~ Route 58; and
<br />
<br /> WHEREAS, the City of Portsmouth has not been able to purchase the property described herein, necessary to
<br />the project, because of the status of the title of the property; and ~
<br />
<br /> WHEREAS, Advancement Of the work and use of said State Highway Route 59 will be delayed unreasonably if
<br />the said property is not made available as soon as possible. ·
<br />
<br />NOW, T}~REFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia;
<br />
<br /> SM~i~N 1. The City Attorney is directed to institute eminent domain proceedings, employing special
<br />counsel for that purpose if he deems it advisable, against the property hereinafter described located along
<br />State Highway Route 58, for the purpose of acquiring a temporary construction easement therein, together with
<br />any and all easements of access, light, or air incidenz to the lands of the landowner abutting upon. said
<br />Limited Access Highway and/or upon any of its ramps, loops, or connections at and with intersecting highways,
<br />in accordance with and pursuant to Section 23 (E) of the Charter of the City of Portsmouth (Chapter 229 of the
<br />Acts of Assembly of 1966), and to deposit to the credit of th~ court as provided by law the sum.hereinafter
<br />specified to compensate the o;mers of the parcel of land, as shown on those certain plans entitled Project 0058-
<br />124~102, R/W 201 and 202 dated February 14, 1966, sheet 5, a copy of which is filed with the Department of Pu~li
<br />Works of the City of Portsmouth, Virginia.

<br /> 69-208 - "I submit the attached appliaation for funding of Community Mental Health and Mental Retardation
<br />Programs in accordance with Chapter 10, Title 57.1, Code of Virginia, for fiscal years 1971~72 and recommend the
<br />proper City officials be authorized to sign.
<br />
<br /> This budget' has been prepared by the Portsmouth Community Mental Services Board that was recently estab~
<br />lished by the City Council at the request of Mrs. Louis Brenner and Mrs. W. B. Spong. The budget proposes
<br />expenditures of $487,253 for fiscal 1971 and $1,147,233 for fiscal 1972. Of these funds, $660,000 is to come
<br />from the Federal Government and $472,766 from the State. $501,700 will be local fund~, but none of this is
<br />funded from City Government revenues. These ~ocal funds will come from contributions :~asso¢iations, clubs,
<br />individuals, etc.) a~d the United Fund.

<br /> While this application requires no local funds of the City Government, the State law requires that it be
<br />approved by the City Coun~iI and submitted to the State by the local government."

<br /> On motion of Mr. Turner, the proper ~ty officials were authorized to sign the application, without
<br />dissenting vote.

<br />1961, INCREASING THE TAX ON THE SALE OF CIGANETTES."
