<br />EMINENT DOMAIN PROCEEDINGS PURSUANT TO C~APTER 229 OF THE ACTS OF ASSEMBLY OF 1966, SAID PROPERTY
<br />BEING NECESSARY FOR THE CONSTRUCTION, WIDENING AND Ib~PROVEMENT OF STATE HIGHWAY ROUTE S8 FROM THE
<br />INTERSECTION OF AIRLINE BOULEVARD AND HIGH STREET TO THE INTERSECTION OF LflNDON AND EFFINGHAM

<br /> ~{BREAS, in cooperation with the Federal and State governments, State Highway Route 58 is being con-
<br />structed, widened and improved from the intersection of Airline Boulevard and High Street to the inter-
<br /> Vlr~lnla,~and
<br />section of London and Effingham Streets in the City of Portsmouth, ' ~' ' ·

<br /> I%~EREAS, Part of said highway has ~een des~BBated as a Limited Access Highway in accordance with the
<br />provisions of Article $, Chapter 1, Title SS, of the 19S0 Code of Virginia as amended; and
<br />
<br /> %YHEREAS, one of the obligations of the City of Portsmouth with respect to said project is the provision
<br />of the land necessary for the construction; and
<br />
<br /> %FHERBAS, the City of Portsmouth has found it to be necessary to acquire the interests hereinafter
<br />specified in and to the hereinafter described parcel of land situate in the City of Portsmouth, Virginia,
<br />for the purposeof constructing, widening .and improving the aforesaid State l~ghway Route 58; and
<br />
<br /> WHEREAS, the City of Portsmouth has not been able to purchase the property described herein, necessary
<br />to thelpr~ect, because of the status of the title of the Property; and
<br />
<br /> ~BREAS, advancement of the work and use of said State Iiighway Route 58 will be delayed unreasonably if
<br />the said property is not made available as soon as possible.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council o-f the City of Portsmouth, ' o' ' ·

<br /> Section 1. The City Attorney is directed to institute eminent domain proceedings, .employing special
<br />counsel for that purpose if he deems it advisab~, against the property hereinafter described located along
<br />State Highway Route 58~ for the purpose of acquiring fee simple title and a temporary construction easement
<br />therein~ together with any and all easements of access, light, or air incident to the lands of the landowner
<br />abutting upon said Limited Access Highway and/or upon any of its ramps, loops, or connections at and with
<br />intersecting highways, in accordance with and pursuant to Section 23 (F) of the Charter of the City of
<br />Portsmouth (Chapter 229 of the Acts of Assembly of 1966), and to deposit to the credit of the court as pro-
<br />vided by law the sum hereinafter specified to compensate the owners of the parcel of land, as shown on those
<br />certain plans entitled Project 0058-124-102, R/W 201 and 202 dated Fe~'ruary 14, 1966, sheets 8 ~ 9 and 5 ~ 6
<br />respectively, copies of which are filed with the Department of Public Works of the City of Portsmouth, Virginia

<br />of sidewalks in the 2400 block of Piedmont Avenue. This petition has been signed by 75% of ~ke property owners
<br />requesting these sidewalks and submitted in accordance with the City ~ode.? There are four property owners
<br />in this block -- three of which signed the petition. ~It will be necessary for the Council to open the floor
<br />for any objectors."

<br />On motion of Mr. Turner, the following resolution was adopted, without dissenting vote:

<br />PIEDMONT AVENUE, ~FHBRE STANDARD SIDEWALKS DO NOT NOW EXIST, THE COST THEREOF TO BE APPORTIONED
<br />BETWEEN THE CITY AND THE ABUTTING L;~NDO¥~BRS, AND DIRECTING THAT AN ABSTR~ET OF THIS RESOLUTION BE
<br />RECORDED TOGETHER WITH A STATEMENT SHOWING THE ESTIMATED ~%MOUNT THAT WILL BE ASSESSED AGAINST
<br />EACH SUCH LANDOWNER
<br />
<br /> WHEREAS, by petition submitted in accordance with law certain abutting landowners have petitioned the
<br />City of Portsmouth to construct a sidewalk along the west side of the 2400 Block of Piedmmnt Avenue, Lots
<br />12 through 19 inclusive in Block No. 37, where standard sidewalks do not now exist, the cost thereof to be
<br />apportioned between the City and the abutting landowners; and
<br />
<br /> I~EREAS, notice has been duly given to the butting landowmers, as providod by law, that a bearing would
<br />be held before tile Council of the City of Portsmouth on July 8, 1969, at 7:50 P.M~ in the Council Chambers;
<br />and
<br />
<br /> WHEREAS, said hearing was duly !teld and in the judgment of the Council the said sidewalk should be
<br />constructed.

<br />NO~I, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth:
