<br />At a regular meeting of the City Council, held on July 8, 1969, there were present:
<br />
<br />Jack P. Barnes, James W. Holley, Burrell R. Johnsan, Isaac ~. ~g, R~ Irvine Smith, Raymond Turner,
<br />A. P. Johnson, Jr., City Manager, and James Jones, Assistant City Attorney.
<br />
<br />The meeting was opened with prayer by ~ir. ring.
<br />
<br />M~nutes of the previous Council meetings-'w~re read and approved.
<br />
<br />69-216 - The following hearing on the Cigarette Tax ordinance was held:
<br />
<br />"NOTICE OF PUBLIC HEARIN'~

<br />CIGARETTE TAX
<br />
<br /> Pursuant to Section 58-846.1 of the Code of Virginia, 1950, notice is hereby given that the
<br />Council of the City of Portsmouth, Virginia, pI~poses to increase the tax on the sale of cigarettes
<br />to seven cents for each twenty cigarettes or fractional number thereof sold, effective August 1,
<br />1969. Citizens will be given an opportunity to appear and be heard rega~ding same at a meeting of
<br />the Council to be held in the Council Chambers on July 8, 1969, at 7:30 PM?"

<br />No one spoke.
<br />
<br /> 69-217 - Leo V. Schocklin, Chairman of the Portsmouth Redevelopment and Housing Authority presented the
<br />annual report of the Authority.
<br />
<br /> Motion of kfr. Smith to commend the Itousing Authority on the re~prt and that the Council endorse the im-
<br />provement of the $outhside neighborhood was adopted, without dissenting vote.
<br />
<br />The following reports fr~m the City Manager were read:
<br />
<br /> 69-218 - "I submit the attached ordinance and recommend it be placed on first reading. This appropriates
<br />$30,60~ for the operation of the-High Constable's office for fiscal 1969-70. q~lis provides for salaries in
<br />the office of $26,184. Travel in the amount of $1,420 pays on a mileage basis for the use of private automobile~
<br />$500 is allowed for printing, $1,000 for supplies and materials, and $1,500 for equipment. It is estimated that
<br />$58~000 in revenues will be received through this office.
<br />
<br /> As of July 1st, this office was moved into the City-owned building adjacent to the library.' This is on a
<br />temporary basis as this office will be located in the new Civic Center when completed."
<br />
<br /> On motion of Mr. Holley, the following ordinance ~as approved on 'first reading, without dissenting vo~e:
<br />
<br /> "AN ORDINANCE TO APPROPRIATE $50,694.00 FROM THE GENERAL FUND FOR OPERATION OF THE OFFICE
<br /> OF THE HIGH CONSTABLE."
<br />
<br /> 69-219 - "I submit the attached ordinance and recommend it be placed on first reading. This ordinance
<br />appropriates $9,540 for the Southeastern Tidewater Opportmlity Project. This represents Portsmouth's share,
<br />as a participating member, of local funds for the operation of this organization. I am recommending this
<br />appropriation contingent upon the other political subdivisions agreeing to their cost based on the population
<br />figures used from the Tidewater Virginia Development Council."
<br /> On motion of Mr. Turner, the following ordinance was approved on firs~ reading without dissenting vote:
<br /> "AN ORDINANCE TO APPROPRIATE $9,540.00 FROM THE GENERAL FUND IS THE CITY'S CONTRIBUTION TO THE
<br /> SOUTHEASTERN TIDEWATER OPPORTUNITY PROJECT."

<br /> 69-220 - "I sffDmit the attached ordinance and recommend it be placed on. first ~eading. This provides
<br />compensation for policemen and Firem~tn when they have to attend Court on their off-duty hours. It allows a
<br />payment of $5.00 for their appearance in all courts.
<br />
<br /> At no time would any officer be paid for his appearance in Court while on duty, and at no time time will
<br />more than. one officer receive pay for appearing on the same case unless it is necessary that more than one be
<br />required to testify.
<br />
<br /> It is further noted that the $5.00 fee is for the officer's appearance in fiourt on any one day, regard-
<br />less of how many Courts me may be required to appear in on that day."
<br />
<br /> Motion of Mr. Smith to place the following ordinance on first reading, without dissenting vote:
<br /> "AN ORDINANCE TO AMEND SECTION 10 OF ORDINAN,,C~ NO. 1969-46 INCREASING THE WITNESS FEE FOR
<br /> POLICE OFFICERS REQUIRED TO APPEAR IN COURT i~EN NOT ON A REGULAR ASSIGNED PERIOD OF
<br />
<br /> Motion of Mr. Johnson that the rules be suspended to allow Norman Olitsky, Attorney, to speak, was adopted.
<br /> b~r. Olitsky spoke regarding interpretation of sac~io~s{b) and (c) of the ordinance.
<br />
<br /> ~otion of Mr. Johns°n that the ordinance be studied by the City Manager and City Attorney.
<br />
<br /> Substitute motion of Mr. Holley that the matter be referred to the City Attorney for re-drafting, was
<br />adopted, without dissenting vote.
<br />
<br /> 69-221 - "I submit the attached resolution and recommend its adoption. This authorizes condemnation
<br />proceedings f~r property needed for the London-Glasgow Street Highway. This covers a parcel to be acquired
<br />and a temporary easement. ~e have not been able to agree on price with the owner."
<br />
<br />On motion of Mr. Turner, the following resolution was adopted, withouf dissenting vote:
