Petition Z 69-46 - B. M. and Ruth F. Schwetz and M. B. Wilkins <br /> <br />No one spoke. <br /> <br /> Motion of Mr. Johnson that the application be referred back to the planning Commission and City Attorney <br />for study of all junk yards, and to bring back to Council a recommendation, was adopted, without dissenting <br />vote. <br /> <br />Petition Z 69-47 - David C. and Clara. w. Peoples and Ruth C. Angle <br />Mrs. Stallings spoke. <br /> <br />On motion of Mr. Turner, the following ordinance was approved on first reading, without dissenting vote: <br /> <br />"ZONING A~I~NDIYMNT ORDINANCE Z 69-47" <br /> <br />Use Permit 69-18 - Petition of Curtis Coan Metal Company <br /> <br />No one spoke. <br /> <br /> Motion of Mr. Smith to refer this petition back to the Planning Commission, with other junk yard petitions <br />was adopted, without diSsening vote. <br /> <br />Use Permit 69-19 - Cavalier Estates Development Corporation <br /> <br />Raeford Eure spoke. <br /> <br /> Motion of Mr. Turner to concur in the recommendation of the Planning Commission to approve the following <br />resolution was adopted, without dissenting vote: <br /> <br />"A RESOL~F!ON GRAN~ftNG A USE PERMIT FOR THE OPERATION OF A SEWAGE PU~ING STATION AT THE <br />INTERSECTION OF THE INTEP~TATE 264 SERVICE ROAD AND THE WESTERN BROPERTY LINE OF THE LAKEVIEW <br />ELEkrENTARY SO. fOOL SITE, UP-69-19 <br /> <br /> I'~ttEREAS, Cavalier Estates Development 6orporation has made an application pursuant to Section 4-2 of the <br />Zoning Ordinance of the City of Portsmouth, 1961, for ~he granting of a use permit as hereinafter described; <br />and <br /> <br /> WHEREAS, the applicant, the Planning Director and the City Manager have done all things required to be <br />done in connection with said ~pplication, and the Planning Commission has recommended the granting of said <br />use permit, afl, jest to the conditions hereinafter stated. <br /> <br />NOW, THEREF0Pd~, BE IT P£SOL¥]~D by the Council of the City of Portsmouth, Virginia; <br /> <br />That the use for which the use permit hereinafter described is mu~ght (1) will not <br />adversely affect the health or safety of persons residing or working in the neighbor- <br />hood of the proposed use, (2) will not be detrimental to the public welfare or injurious <br />to property or improvements in the neighborhood, and (3) will be in accord with the <br />purpose of said Zoning Ordinance. <br /> <br />That Cavalier Estates Development Corporation is hereby granted a use permit, subject <br />to site plan restrictions, pursuant to Section 4-2 of said Zoning Ordinance, for the <br />operation of a sm~age pumping station located on the property described as follows: <br /> <br /> Beginning at the intersection of the west property line of Lakeview Elementary School <br /> with the sout~ right-of-way line of the Interstate 264 service road; thence southwest <br />. mtongm~curve 46.4 feet; thence southeast 50 feet; thence northeast 40 feet to said school <br />.p~oper~y:, %in~ ~h~nce, northwest 73.5 feet to the point of origin." <br /> <br />Use Permit 69-21 - Petition of Humble Oil and Refining Company <br /> <br /> Motion of Mr. King to concur in the reco.wmendation of the Planning Comnission to approve the following <br />resolution was ad~pted, without dissenting vote: <br /> <br />"A RESOL~£ION GRANTING A USE PEIhMIT FOR THE OPERATION OF AN AUTOMOTIVE SER¥I~ STATION <br />AT THE,NORTHEAST CORNER OF EFFINGH~M AND LONDON STREETS, UP-69-21 <br /> <br /> I~CdEREAS, hUmble Oil and Refining Company has made an application pursuant to Section 4-2 of the Zoning <br />Ordinance of the City of Portsmouth, 1961, for the granting of a use permit as hereinafter described; and <br /> <br /> IfHEREAS, t~he applicant, the Planning Director mhd the City Manager have done all things required to be <br />in connection with said applicatiog, and tJ~e Planning Commission has recommended the granting of said use per- <br />mit,.~._ffa~ee~ ~6 ~he conditions hereinafter stated. <br /> <br />NOW, THEREFORE, BE IT RESOL%DED by the Council of the City of Portsmouth, Virginia; <br /> <br />A.
