<br /> 70-164 - "I submit the attached ordinance and recommend it be placed on first reading. This appropriates
<br />$S00 for preliminary work necessary towards the acquisition of property on Booker Street.

<br /> ~nis is the area that is proposed for a new park, and the land, presently owned by the City, is being
<br />used for the storage of fill materi~l being removed from the London-Glasgow Street Highway at the present time.
<br />~lere is need for additional land at this time in order to store additional fill material? These are scattered
<br />parcels of land among the properties owned by the City."

<br /> On motion of Mr. Turner, the following ordinance, was approved on first reading, and by the following
<br />vote:

<br />ACQUISITION OF L.~ND ON BOOKER STREET."

<br /> 70-16S - "Our contract with the City of Norfolk for the h~ming of Portsmouth prisoners in the Norfolk
<br />Jail expired April 26, 1970. Since our new jail facilities are not available at this time, it has been
<br />necessary to eJtend the present contract for an additional six months. It is anticipated that we will not
<br />have to use the Norfolk Jail for the entire six months' period.
<br />
<br />I recommend that the City Council confirm and ratify signing of this contract."
<br />
<br /> Motion of b~r. Holley to concur in the recommendation of the City Manager to ratify signing of the contratt
<br />was adopted, without dissenting vote.
<br />
<br /> 70-166 - "I submit the attached resolution and recommend its adoption. This requests the State Highway
<br />Department to acquire the flint-of-way for the Western Freeway. In accordance with the Code of Virginia, it
<br />is necessary to adopt this resolution in order to have the Highway Department acquire this right-of-way. This
<br />com~its the City to participate in 15% of the cost of this right-of-way acquisition."

<br />On motion of Mr. Smith, the following resolution was adopted, and by the following vote:

<br />"RESOLUTION REQUESTING THE STATE HI~AY CO~4ISSIONER TO ACQUIRE THE RIGHT OF WAY FOR THE
<br />WESTERN FREEWAY, PRGJECT 0164-124-102, R/W ~t
<br />
<br /> !~fHERBAM, Section 53-57 of the Cod~ of Virginia, as mmended by the 1966 session of the General Assembly,
<br />authorizes the State Highway Co~missioner to acquire rights of way for the construction, reconstruction, al-
<br />teration, maintenance and repair of p~lic highways ~thin municipalities on projects which are constructed
<br />with State or Federal participation; and
<br />
<br /> ~EREAS, Section SS-ST, as amended, further provides that the State Highway Commissioner may exercise
<br />such authority only upon receipt of official request from the city or town involved.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth that it here~equests the State
<br />Highway Commissioner to acquire the necessary rights of way for Project 0164-124-102, R/W/within the corporate
<br />limits of said City and to convey the title to such right of way to the City of Portsmouth upon completion
<br />of the project. The City of Portsmouth agrees to reimburse the State Highway Department. fOr fiteen percent
<br />(15%) of all costs incurred in the acquisition and conveyance of such flights of way and it is understood that
<br />such acquisitions will be handled by the Commissioner under established policies and procedure~ and his de-
<br />cision in all instances shall be final."

<br /> 70-167 - "I submit the. attached resolution and recommend its adoption. This is a similar resolution to
<br />the previous one, except thi.s requests the State Highway Department to acquire the fight-of-way for the con-
<br />sti~uction of the new West Norfolk Bridge."

<br />On motion of Mr. Turner, the following resolution was adopted, and by the following vote:

<br />cormpletion of the project. ~ne City of Portsmouth agrees to reimburse ~e State Highway Department for fifteen
<br />percent (15%0 of all costs incurred in the acquisition and conveyance of sudt rights of way and it is under-
