<br />Mr. Sipler spoke.
<br />
<br />On motion of Mr. ~m_tn, the following resolution was adopted, and by the following vote:
<br />
<br />"A RESOLb~fION G~ANTING A USE PE~4IT FOR THE OPERATION OF AN ALWOMOTIVE SERVICE STATION
<br />AT THE SOUTHEBST INTERSECTION OF AIRLINE AND PORTSMOLrFH BOULEVARDS
<br />
<br /> ~EREAS, L. R. ?d~itlow has made application pursuant to Section 4-2 of the Zoning Ordinance of the City
<br />of Portsmouth, 1961, for the granting of a use permit as hereinafter described; and
<br />
<br /> ~I~E.REAS, the applicant and the Planning Directorhave done all fnings required to be done in connection
<br />with said application, smd the Planning Commission has recommended the granting of said use permit, subject to
<br />the conditions hereinafter stated.
<br />
<br />NOW, THEREFORE, BE IT RESOL\r~D by the Council of the City of Portsmouth, Virginia:
<br />
<br />That the use for ~nich the use permit hereinafter described is south (i) will not adversely affect
<br />the health or safety of persons residing or working in the neighborhood of the proposed use, (2)
<br />will not be detrimental to the pl~lic welfare or injurious~o property or improvements in the neighbor-
<br />hood, and (S) will be in accord ~th the purposes of said Zoning Ordinance.
<br />
<br />That L. R. ~%~itlow is hereby granted a use permit, subject to site plan restrictions, pursuant
<br />to Section 4-2 of the said Zoning Ordinance, for the operation of mn automotive service station
<br />located on the property described as follows:
<br />
<br />Beginning at a p6int on the sou~east intersection of Airline and Portsmouth
<br />Boulevards; thence running northeast 291 feet; thence running southeast 250.45
<br />feet to Portsmouth Boulevard; thence running parallel to said Portsmouth
<br />Boulevard sou~Ywest 154.45 feet; thence continuing parallel to Portsmouth
<br />Boulevard along a radius 85.54 feet; thence northwest 42.90 feet to ~he point
<br />of origin."

<br /> WHERE. ES, Humble Oil and Refining Company has made an application pursuant to Section 4-2 of the Zoning
<br />Ordinmnce of the City of Portsmouth, 1961, for the granting of a use permit as hereinafter described; and
<br />
<br /> ]'~.~EREAS, the applicant and the Planning Director have done all things required to be done in connection
<br />with said application, and the P!mnning Commission has recommended the granting of said use permit, subject
<br />to the conditions hereinafter stated.

<br />restrictions pursuant to Section 4~of said Zoning Ordinance, for the operation of an auto-
<br />motive service station located on the property described as follows:
<br />
<br />Beginning at a point a~ the northwest intersection of Victory Boulevard and
<br />Greenwood Drive; thence running southwest along GreenwSod Drive~28~<~feet; thence
<br />running northwest 238.90 feet; thence running northeast 200 feet to Victory Boule-
<br />vard; thence running along said Victory Boulevard southeast 238.40 feet to the
<br />point of origin."

<br />
<br />The following reports from the City Manager were read:
<br />
<br /> 70-207 - "I submit the attached ordinance and recommend it be placed on first reading. This establishes
<br />a minimum ne~nt for utility lines ~along the streets and highways of the City, It establishes a minimum height
<br />of eighteen (18) feet for the installation of any line. ~%is parallels the State requirements."
<br />
<br />Motion of Mr. Holley to place the follmving ordinance on first reading:

<br /> Motion of Mr. Holley to suspend the rules to hear Allen Leibler, Planning Engineer for the Chesapeake &
<br />Potomac Telephone Company was adopted.
