<br />On motion of Mr. Smith the following resolution was adopted and by the following vote:
<br />
<br />"A RESOLUTION GRANTING A USE PERMIT FOR THE OPERATION OF AN AUTOblOTIVE SERVICE STATION
<br />ON THE SOUTH SIDE OF PORTSMOUTH BOULEVARD WEST OF ITS3INTEP~ECTION WITH TURNPIKE ROAD
<br />
<br /> WHEREAS, Mobil Oil Corporation has made an application pursuant to Section 4-2 of the Zoning Ordinance
<br />of the City of Portsmouth, 1961, for the granting of a use permit as hereinafter described; and
<br />
<br /> I~EREAS, the applicant and the Planning Director have done all things required to be done in connection
<br />with s~id application, and the planning Commission has recommended the granting of said use permit, subject
<br />to the conditions hereinafter stated.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br />That the use for which the use permit hereinafter described is sought (1)will not adversely affect the
<br />health or safety of persons residing or working in the neighborhood of the proposed use, [2) will not
<br />'be detrimental to the public Welfare or injurious to property or imnrovements in the neighborhood,
<br />and (5) will be in accord with the purposes of said Zoning Ordinance.
<br />
<br />~at the Mobil Oil Corporation is hereby granted a use permit, subject to site plan restrictions,
<br />pursuant to Section 4-2 of said Zoning Ordinance, for the operation of an automotive service
<br />station located on the property described as follows:
<br />
<br />Beginning at a point on the southern ~ight-of-way line of Portsmouth Boulevard which
<br />said point is 550 feet, more or less, West of the eastern corner of the intersection ~
<br />of Portsmouth Boulevard and Turnpike Road; thence running South a distance of 180
<br />feet, more or less, to a point; thence running West a distance of 200 feet, more or
<br />less· to a point; thence running North~ along the eastern right-of-way line of the
<br />proposed sh~pping center road along the arc of a curve to the right whose radius is 522
<br />feet a distance of 196 feet, more or less, to a point; thence running East along said
<br />southern right-of-way line of Portsmouth Boulevard a distance of 150 feet, more or less,
<br />to the point of beginning.
<br />
<br />Furthermore, this use permit is granted subject to a restriction limiting the maximum width of
<br />driveways for said site to $5 feet and with the understanding that the median strip in tkgp~ppomed
<br />shopping center road will not be cut to allow access to this automotive service station site."

<br />The following letter from Attorney Donald C. Kilgore was read:
<br />
<br /> "Schedfiled for public hearing on Tuesday, July 28, is the abovercaptioned zoning matter. Certain limita~
<br />tions were noted to the proposed urban development plan submitted by Mr. R. S. Collins by the Planning Commissio
<br />Since the Planning Commission's meeting, Mr. Collins has been in negotiation with various persons relative to
<br />curing some of the indicated limitations. _ No final action to these limitations is evident ~t this point.
<br />However, it is requested that this matter be continued~ so that the proposed negotiations could be continued
<br />with the expectation that major objections to ~he rezoning by neighboring property owners ~uld be cured.
<br />It would, therefore, be appreciated if Mou would continue this application until further notified. Any cost
<br />of readvertisement of the public hearing will be borne by Mr. Collins and guaranteed by this writer."
<br />
<br />Attorney J. N. Garrett, Jr., spoke and presented the following petition:
<br />
<br /> "TRg::-residents of ~avalier Forest, Westwood, Castle }{eights, and Hatton Point, whose signatures appear
<br />below have no objection to the Development of the tract known as ~estview. Greene provided the present Zoning
<br />of R-150 requirements be retained.
<br />
<br /> However, any request for rezoning that would increase the average density and/or depreciate property values
<br />as they presently exist, will be opposed by the undersigned residents."(Signed - WilliamsE. Williamson~ Jr., and
<br />others)

<br />Motion of Mrl Johnson to postpone until the matter can be reheard was lost, there being no second.

<br /> Motion of Mr. Turner to refer back to the Planning Commission with the request that the Commission report
<br />back to the Council within thirty days, was adopted, and by ~he following vote:
