This was a surplus parcel of right-of-way that was acquired for the construction of Frederick Boulevard. The land is of no value to the City. One bid was received from Mr. Dallas C. Wilkins in the amount of $S01. that the property be awarded to Mr. Wilkins." I recommend Motion of Mr. Turner to concur in the City Manager's recommendation and ~ward the bid to Dallas C. Wil~kins was adopted, without dissenting vote. 70-363 "I submit the attached letter from the City Assessor recommending a rebate in taxes due to an erroneous assessment. I recommend that the rebate in the amount of $104.27 be Daid~to W. Parrish and Virginia Melms of 4513 Wake Forrest Road." "Through an error chargeable to this office, an erroneous assessment was made on subject property for 1969 and 1970. Therefore, by councilmatic action iS is necessam¥ to rebate the 1969 1st and 2nd Qtrs. $ 34.75 1969-70 1st, 2nd, Srd & 4th Qtrs. 69.52 owner the following: Total amount due prope~%y owner $104.27" Motion of Mr. King that the refund be granted was adopted, with one dissenting vote, that of Mr. Holley. - UNFINISHED BUSINESS - 70-550 - Motion of Mr. King to go into the election of a member to the Law Library Board to fill the vacancy caused by the resignation of Lester E. Schlitz. Mr. Holley nominated Carroll O. Ferrell. On motion of Mr. Johnson, nominations were closed. Vote being taken, Mr. Ferrell was elected a member of the Portsmouth Law Library Board, the term expiring November 1~ 1975. 70-356 - The following ordinance, approved on first reading at last meeting, was taken up and read: "AN ORDINANCE TO A~ND SECTION 10-19 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1961, EXTENDING FROM T~OYEARS TO FIVE YEAP~ THE PERIOD OF TIME IN l'~{IOt BOND A~FFICIPATION NOTES ~ST BE RETIRED." On motion of Mr. Turner, the ordinance was adopted, and by the following vote: Ayes: Holley, Johnson, King, Smith (R), Turner, Barnes Nays: None 70-557 - The following ordinance, ~proved on first reading at last meeting was taken up and read: "AN ORDINANCE TO CLOSE A PORTION OF COLUMBIA STREET." On motion of Mr. J~nnson, the ordinace was adopted and by the following vote: Ayes: Holley, Johnson, King, Smith (R), Turner, Barnes Nays: None - NEW BUSINESS - Y0-366 - The following letter from the City Clerk was read: "The term. of James A. Overton, as a member of the Portsmouth Redevelopment and Housing Authority, will expire September 11, 1970." On motion of Mr. Turner referred to a conference. 70-567 - The following petition from residents of Shelby Court was read: "I{e, the undersigned residents of Shelby Court in Douglas Park, respectfully partition the Portsmouth City Council to assum~the undedicated same court and provide the necessary improvements to make it safe, healthy, and useable for the tax paying Portsmouth Citizens who herewith reside there. [Signed - Willie Johnson and others)" Motion of Raymond Smith to refer to the City Attorney for investigation and report was adopted, without dissenting vote.
