<br /> "A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY
<br /> THE CITY OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PROCEEDINGS
<br /> PURSUANT TO CHAPTER 471 OF THE ACTS OF ASSEMBLY OF 1970, SAID PROPERTY
<br /> BEING NECESSARY FOR THE CONSTRUCTION, MAINTENANCE AND RENOVATION OF A
<br /> SANITARY SEWER SYSTEM TO BE LOCATED BETWEEN BOOKER STREET AND HILL
<br /> AVENUE IN THE CITY OF PORTSMOUTH.

<br /> WHEREAS, the City of Portsmouth has found it necessary to acquire the interest hereinaf':er
<br />specified in and to the hereinafter described parcels of land situate in the City of PortsmoUth,
<br />Virglnia, for the purpose of construction, maintaining and renovating the aforesaid sanitary~
<br />sewer system; and
<br />
<br /> WHEREAS, the City of Portsmouth has not been able to purchase the property described
<br />herein, necessary to the project, because the owners thereof and the City have not been
<br />able to agree upon the price to be paid therefor, or the City has not been able to locate
<br />certain of the owners or because of the status of the title of certain parcels of the properly;

<br />
<br /> WHEREAS, advancement of the work and use of said project will be delayed unreasonably
<br />if the said property is not made available as soon as possible.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:

<br /> 1. The City attorney is directed to institute eminenl domain proceedings, employing
<br /> special counsel for that purpose if he deems it advisable, against the following
<br /> property situate in the City of Portsmouth, for the purpose of acquiring fee
<br /> simple title therein, together with any and all easements of access, light
<br /> or air incident to the lands of the landowner abutting upon said property,
<br /> in accordance with and p~rsuant to Sections 2.06, 2.07 and 2.08 of the Charter

<br /> 70-448 -"I submit the attached resolution and recommend its adoption. This authorizes
<br />the execution of an agreement between the Seaboard Coast Line Railroad, the City of Chesa-
<br />peake and the City of Portsmouth for the maintenance of a~storm drain under the railroad's
<br />tracks. This is an agreement that is necessary for the City to take over from the City
<br />of Chesapeake due to annexation. The Seaboard Coast Line had an agreement with the City of
<br />Chesapeake when the storm drain was locate~ in that City. Now that the storm drain is in
<br />the City of Portsmouth, the railroad company is requesting the City to assume the responsi-
<br />bility for maintaining this line under the railroad's tracks.

<br /> This storm drain is in the Churchland area and crosses under the railroad's Pig Point
<br />branch line.TM
