October t5. 1970 <br /> <br />At a regular meeting of the City Council, held on October t3, 1970, there:were present: <br /> <br />Jack P. Barnes, James W. Holley, Burrell R. Johnson, Isaac W. King, R. Irvine Smith, Raymond B. Smith, <br />Raymond Turner, A. P. Johnson, Jr., City Manager and W. T. O*Brien, Assistant City Attorney. <br /> <br />The meeting was opened with prayer by Rev. Harvey Glass. <br /> <br /> The following reports from the City Manager were read: <br /> <br /> 70-444 - "I submit the attached ordinance and recommend it be p~aced on' first reading. <br />This appropriates $S0,000 from the surplus in the City Garage fund. These funds are to be <br />used to purchase automotive equipment and construction equipment, such as paving breakers, <br />hot-mix trailer, portable roller, asphalt spreader, etc. <br /> <br /> · ' ' · herr eneral o eratJ <br /> This equipment was requested by the departments when they suomitted t ' g p 'ina <br />budget requests. They were deleted from the general fund operating budget, but it is recommenqed <br />that they be purchased from the City Garage fund surplus." <br /> On motion of Mr. Smith (I) the following ordinance was approved on first reading, and bytthe <br /> "AN ORDINANCE TO APPROPRIATE $50,000.00 FROM THE CITY GARAGE FUND FOR THE vote: <br /> PURCHASE OF AUTOMOTIVE EQUIPMENT." <br /> <br /> Ayes: Holley, Johnson, King, Smith (I), Smith (R), Turner, Barnes <br /> Nays: None <br /> <br /> 70-445 - "I submit the attached ordinance and recommend it be placed on first reading. <br />This appropriates $77,070 for the operation of the Portsmouth Mental Health and Mental Retardation <br />Services Board. This appropriation is being requested in order that 8tare funds and local <br />funds can be expended through the mental health services fund. <br /> <br /> The State requires that a separate fund be established for the operation of the blental <br />Health Services Board, and this fund will receive $57,012 from the State, $16,670 of City <br />funds, and $3,388 of other local funds. The City's share of these monies was appropriated <br />in the general operating budget and they will be transferred to this fund." <br /> <br /> The motion of Mr. Smith (R), the following ordinance wa.s ~approved on first reading, <br />and by the following vote: <br /> <br />"AN ORDINANCE TO APPROPRIATE $77,070.00 FROM THE MENTAL HEALTH SERVICES FUND <br />FOR THE OPERATION AND ADMINISTRATION OF THE MENTAL HEALTH PROGRAM." <br /> <br />Ayes: Hol~ey, Johnson, King, Smith (I), Smith (R), Turner, Barnes <br />Nays: None <br /> <br /> 70-446 "I submit the attached resolution and recommend its adoption. This appoints <br />viewers for the closing of Railroad Avenue between Deep Creek Boulevard and Portsmouth Boule~ <br />yard, and for the closing of two unnamed alleys in the same general area. The closing of <br />this street and the two alleys has been requested by Angelina Bates, Louis J. Bates, and <br />Frank P. Bates, and the Norfolk and Portsmouth Belt Line Railroad Company. <br /> <br />has <br /> <br />The resolution appoints five viewers <br />recommended these closings." <br /> <br />On motion of Mr. King, the following <br /> <br />to report to the Council. The Planning Commission <br />resolution was adopted, and by the following vote: <br /> <br />"A RESOLUTION APPOINTING VIEWERS FOR THE CLOSING OF RAILROAD AVENUE BETWEEN <br />DEEP CREEK BOULEVARD AND PORTSMOUTH BOULEVARD AND FOR THE CLOSING OF TWO <br />UNNAMED ALLEYS IN THE SAME GENERAL AREA. <br /> <br /> WHEREAS, Angelina Bates, Louis J. Bates, Frank P. Eates and Norfolk and Portsmouth Belt <br />Line Railroad Company have made application to vacate and close the hereinafter described <br />portions of a certain street and two unnamed alleys and it appearing that notice of the applY, <br />zi6nyand request for appointment of viewers was duly posted on September $0, 1970 on the <br />bulletin board of the Court of Hustings for the City of Portsmouth, on the bulletin board <br />of the Circuit Court of the City of Portsmouth, and on the bulletin board of the Municipal <br />Court, Civil Division of the City of Portsmouth. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PORTSMOUTH, VIRGINIA, that <br />Frank N. Bilisoly, L. A. Clark, Luther Tapp, James Choate and Loyed W. Gardner be appoint- <br />ed viewers to view the hereinafter described portions of a street and two unnamed alleys <br />and report to this Council in writing whether in their opinion any, and if any, what inconven~ <br />ience would result from vacating and closing the following: <br /> <br />Railroad Avenue lying between Portsmouth Boulevard on the South and Deep Creek <br />Boulevard on the North. <br /> <br /> 2. A certain 10 foot alleyway which runs generally in an EastWest direction through <br />Block 7, as shown on the plat of Piedmont Heights, recorded in Map Book 4, page 52, in the <br />Clerk's Office of the Circuit Court of the City of Chesapeake, Virginia, which alleyway to <br />be closed is more particularly described as bounded on the West by the eastern right of <br />way line of Railroad Avenue and on the East by a prolongation to the South of the eastern <br />property line of Lots 50 and 31 in said Block 7 as shown on the plat aforesaid. <br /> <br />following <br /> <br /> <br />
