October 27_ 1970, NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PORTSMOUTH, VIRGINIA. SECTION t. For the purpose .of providing ~funds for street construction, there shall be issued Seventyfive Thousand Seven Hundred Eightyfive and no/100 ($75,785.00) Uollars of bonds of the City of Portsmouth, to be known as General Obligation Bonds, pursuant to the provisions of Chapter 5 of Title 1S.1 of the Code of Virginia and other provisions of law applicable thereto. The said bonds shall be serial bonds and shall be issued at one time or a part thereof from time to time and shall be in such form and of such denomination as the Council shall direct. Each issue shall be payable not exceeding forty (40) years from its date, and said bonds shall bear interest at a rate or rates to be hereafter determined by the Council, upon the sale of said bonds, provided that the maximum rate of interest shal not exceed the maximum rate of interest authorized by law at the time of the sale of said bonds. SECTION 2. This resolution shall take effect from its passage." Ayes: Holley, Johnson, King, Smith (R), Barnes Nays: None 70-466 - "I submit the attached ordinance and recommend it be placed on first reading. This appropriates $1,500 for the purchase of equipment for the City Library. This repre= sents funds that the Library has received from the State which have not been budgeted." On motion of Mr. Johnson, the following ordinance was approved on first reading, and by the following vote: "AN ORDINANCE TO-APPROPRIATE $1,S00.00.FROM THE GENERAL FUND FOR THE PURCHASE OF EQUIPMENT FOR THE PORTSMOUTH PUBLIC LIBRARY." Ayes: Holley, Johnson, King, Smith (R), Barnes Nays: None 70-467 "I submit the attached ordinance and recommend it be placed on first reading. This closes Railroad Avenue between the southern right-of-way line of Deep Creek Boulevard and the northern right-of-way line of Portsmouth Boulevard. It also closes portions of two 10-ft. unnamed alleys in the general area of Railroad Avenue. These closings have been re- quested by Angelina Eates, Louis J. Eates, Frank P. Eates and the Norfolk and Portsmouth Belt Line Railroad Company. These closings have been approved by the Planning Commission and a is attached hereto.'~ On motion of Mr. smith (R) the following ordinance was approved on the following vote: report of the viewers first reading, and "AN ORDINANCE TO CLOSE PORTIONS OF RAILROAD AVENUE AND TWO UNNAMED ALLEYS." Ayes: Holley, Johnson, King, Smith (R), Barnes Nays: None 70-468 - ~e have received notice from the Virginia State Library that federal funds in the amount of $52,604 are available to the City for the construction of the Churchland Branch Library. The City's original request was for a sum of $62,622 representing 50% of the estimated total cost for this project. The amount approved is $10,018 less than what we applied for. City notify them if we plan to proceed with the const~c- The State has requested that the tion of the library and use these federal funds. The construction of the library is a com-i mitment made by the City when this area was annexed. It is my recommendation that we proceeld with the construction of this library with modifications due to the reduction of the federal~ grant and that we so notify the State." Motion of Mr. King to concur in the recommendation of the City Manager was adopted without dissenting vote. 70-469 - "I recommend that the proper City officials be authorized to sign a deed conv~ fg ing to Maryview Hospital that portion of West Road accruing to the City due to the closing of this street." Motion of Mr. Johnson that the proper city officials be authorized to sign the deed was adopted~ without dissenting vote. 70-470 "I recommend that the proper City officials be authorized to sign an agree- ment between Maryview Hospital and the City of Portsmouth for the use of West Road. This lease will allow the City to maintain and repair the street for use by the general public as a means of vehicular access and right-of-way from High Street. This will allow the strec to remain open until such time as Maryview Hospital needs the land for the construction of the Community Mental Health Center." PRESENT - MR. TURNER Motion of Mr. Holley that the proper city officials be authorized to sign the agree- ment ~a$ adopted, without dissenting vote.
